ANNE ARUNDEL COUNTY

Bill No. 169-72

AN ORDINANCE to repeal Section 13-343.29 of the Anne
Arundel County Code (1967 Edition and
Supplements), Title 13, "Planning and Zoning,"
Subtitle 3, "Alternate Zoning Regulations,"
Article XI, "Special Exceptions," Heading, "Other
Special Exceptions," and to enact new Section
13—3 43.29 in lieu thereof, to stand in the place
of the section repealed, to repeal and re—enact,
with amendments, Section 13-303.2, 13-304.1(2)
and 13-320.2(a) of said Code, Title and Subtitle,
Article III, "Residential Districts," Heading
"General Provisions," Subheading "RA-Agricultural
Residential Districts" and "RI-Residential
Districts," Article VI, "Special Districts,"
Heading "DD—Deferred Development Districts,"
respectively, to permit County operated sanitary
landfills in RA—Agricultural Residential
Districts and DD—Deferred Development Districts,"
subject to certain conditions, and matters
generally related thereto.

SECTION 1. BE IT ENACTED BY THE COUNTY COUNCIL
OF ANNE ARUNDEL COUNTY, MARYLAND, That Section
13-343.29 of the Anne Arundel County Code (1967
Edition and Supplements), Title 13, "Planning and
Zoning," Subtitle 3, "Alternate Zoning Regulations,"
Article XI, "Special Exceptions," Heading, "Other
Special Exceptions," be and it is hereby repealed, and
new Section 13—343.29 be and it is hereby enacted in
lieu thereof, to stand in the place of the section
repealed, and to read as follows:

Section 13-343.29. Sanitary Landfills.

Sanitary landfills shall be        permitted in

RA—Agricultural Residential Districts,         DD—Deferred

Development Districts and W2 and W3     — Industrial
Districts, provided:

(1)   The minimum land area for such operation
shall be not less than one hundred (100) acres.

(2)     Prior to the granting of a special
exception, the application shall present written
evidence signed by the Anne Arundel County Health
Officer that the proposed operation is in compliance
