AN EMERGENCY ORDINANCE to repeal and re-enact, with
amendments, Section 11-410A (c) of the Anne
Arundel County Code (1967 Edition and
Supplements), Title 11, "Health and Welfare",
Subtitle 4, "Sanitary Landfills", to exempt the
Maryland State Highway Administration from
charges for the disposal of certain solid wastes.
SECTION 1. BE IT ENACTED BY THE COUNTY COUNCIL
OF ANNE ARUNDEL COUNTY, MARYLAND, That Section 11-410A
(c) of the Anne Arundel County Code (1967 Edition and
Supplements), Title 11, "Health and Welfare", Subtitle
4, "Sanitary Landfills", be, and it is hereby repealed
and re-enacted, with amendments, to read as follows:
Section 11-410A
(c) The above rates shall not be applicable in
those instances in which the county is contractually
obligated to provide a sanitary landfill facility, NOR
TO THE MARYLAND STATE HIGHWAY ADMINISTRATION FOR THE
DEPOSIT OF ROADSIDE LITTER DETERMINED BY THE ANNE
ARUNDEL COUNTY LANDFILL SUPERVISOR TO HAVE BEEN
GENERATED FROM WITHIN ANNE ARUNDEL COUNTY.
SECTION 2. AND BE IT FURTHER ENACTED, That this
Ordinance is hereby declared to be an emergency
ordinance and necessary for the immediate preservation
of the public peace, health, safety, welfare and
property, and being passed by the affirmative vote of
five (5) members of the County Council, the same shall
take effect from the date it becomes law.
