SHARPSBURG                                            2433

SECTION 2. BE IT RESOLVED by the Mayor and Council of Sharpsburg
that Section 29-8 of the Charter of the Mayor and Council of Sharpsburg as set
forth in Article 22 of Code of Public Local Laws of Washington County (1957
Edition) as said section was enacted by Chapter 99 of Laws of Maryland (1898),
be and the same is hereby amended by adding to said original section that part
thereof which is hereafter underscored and by deleting therefrom that part which is
enclosed with double parentheses, (Note that the symbology has been
changed-Editor.) which section reads as follows:

The method of holding elections in said town shall be as follows: The Mayor
shall publish by hand-bills, posted in at least six public places in said town, at least
ten days prior to the date of said election, the officers to be voted for, or the
objects and purposes of said election in writing, one qualified voter of said town to
act as judge of election who, before he or she shall proceed to act as such, shall
take the following oath or affirmation before the Mayor or a justice of the peace
in Washington County: I will fairly and impartially act as judge of the municipal

election to be held in town of Sharpsburg on the [____________________day of

September, A.D. ..... ] THIRD TUESDAY IN NOVEMBER, A.D. 1972,

according to the best of my knowledge and understanding of law. A certificate that
such oath or affirmation has been administered shall accompany the election
returns as hereinafter provided. On failure of the judge so appointed to appear, the
Mayor shall appoint another qualified person, and so on until a judge is secured;
and in case of death, absence, inability or refusal of the Mayor to appoint, the
duty shall devolve upon the Vice-Mayor, and in case of his death, absence,
inability or refusal, the like duty shall devolve upon one of the Councilmen chosen
by a majority of that body; and upon failure of the Mayor, Vice-Mayor or
Councilmen to perform the duties imposed by this section, they shall be subject to
indictment in the Circuit Court for Washington County, and to a fine of
twenty-five dollars upon conviction. The said judge shall be a conservator of the
peace during the election and until the ballots shall be counted and the returns
made out, and shall have the authority to commit offenders for any breach of the
peace, or interference with the election, for a period of not over twenty days, and
to administer oaths or affirmation to any person touching his qualifications as a
voter. The said judge shall appoint a clerk of election from the qualified voters of
said town, who, before acting as such shall take the following oath or affirmation,
to be administered by the judge; I will well and faithfully keep a true record of all
the votes cast at the municipal election to be held in the town of Sharpsburg, on

the [____________________________________day of September, A.D...............]

THIRD TUESDAY IN NOVEMBER, A.D. 1972, according to the best of my
ability. [A box shall be kept, in which all the ballots received shall be deposited by
the judge, and] The names of all persons voting shall be written on a list by the
clerk. The polls shall be kept open from nine o'clock A.M. until seven o'clock
P.M. Any person not possessing the necessary qualification of a voter at such
election, who shall vote thereat, shall, upon indictment and conviction thereof in
the Circuit Court for Washington County, pay a fine of fifty dollars, or in default
of payment thereof be imprisoned in the county jail for sixty days.

SECTION 3. AND BE IT FURTHER RESOLVED that the date of adoption
of this Resolution is the 9th day of August, 1972, and the amendment of the
Charter of Sharpsburg hereby enacted shall become effective September 28, 1972
unless a proper petition for a referendum hereon shall be filed as permitted by law,
provided a clear and exact copy of this Resolution shall be continuously posted on
the bulletin board in the Town Hall until September 18, 1972, and provided further
that a copy of the title of this Resolution shall be published in the Morning Herald
and the Daily Mail, newspapers of general circulation of Sharpsburg, or in any
other newspaper of such general circulation, once in each of the weeks of August
13th, August 20th, August 27th and September 3, 1974.
