ANNEXATION RESOLUTION

A Resolution of the Mayor and City Council of Frostburg, to enlarge the
corporate boundaries of the City of Frostburg, and thereby amend the Charter of
the City of Frostburg.

WHEREAS, the Mayor and City Council of Frostburg, pursuant to the
authority contained in Article XI-E of the Constitution of the State of Maryland,
and Article 23A, Section 19 of the Annotated Code of Maryland (1957 Edition, as
amended), deem it in the public interest to enlarge the corporate boundaries of the
City of Frostburg, and

WHEREAS, the area to be annexed is contiguous and adjacent to the existing
corporate area, and consent for said annexation has been obtained from the owner
of all the real property located in said area to be annexed, and there being no
persons residing in the said area.

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY
COUNCIL of Frostburg, pursuant to the above mentioned authority, that the
present corporate limits of the City of Frostburg, as described in Section 169 of
the Code of Public Local Laws of Allegany County (Everstine's 1963 Edition), and
in Section 2 of Chapter 662 of the 1953 Acts of the General Assembly of
Maryland, be enlarged to include the following area:

BEGINNING for the same at a point on the existing corporate line, said point
marking the end of the fifth line of the Amended Corporate Boundaries, recorded
December 7, 1965, Map Case Box 124, one of the Land Records of Allegany
County, Maryland, thence leaving said fifth line North 4 degrees 46 minutes 11
seconds East 340.76 feet to a point at the Southwest corner of Lot No. 4, one of
the lots of the subdivision for The Maryland Coal and Realty Company, thence
North 9 degrees 21 minutes 21 seconds East 121.43 feet to a point at the
Southwest corner of Lot No. 5, thence North 22 degrees 03 minutes 44 seconds
East 118.07 feet to a point at the Southwest corner of Lot No. 6, thence North 34
degrees 31 minutes 28 seconds East 120.34 feet to a Point at the Northwest corner
of Lot No. 7, thence North 49 degrees 42 minutes 04 seconds East 311.00 feet to a
point at the Northeast corner of Lot No. 9, thence South 55 degrees 41 minutes 23
seconds East 1367.17 feet to a point at the Northeast corner of Lot No. 41, thence
South 27 degrees 12 minutes 52 seconds West 741.55 feet to a point which marks
the end of the eleventh line of the aforesaid Amended Corporate Boundaries.

AND BE IT FURTHER RESOLVED, That the provisions of the Constitution
and Laws of the State of Maryland applicable to the City of Frostburg which are
now in effect, or which may hereafter be enacted, and the Charter and all existing
Ordinances of the City of Frostburg which are now in force, shall be and the same
are hereby extended and made applicable to the residents and property in this
annexed area.

AND BE IT FURTHER RESOLVED, That the Mayor of the City of
Frostburg shall cause a public notice of the introduction of this Resolution to be
published not less than four times at weekly intervals in a newspaper of general
circulation in the City of Frostburg, and the area to be annexed, briefly and
accurately describing the proposed change and the conditions and circumstances
