CHAPTER 129
(House Bill 113)

AN ACT to repeal and re-enact, with amendments, Section 70-2 (d) (2) of Article
26 of the Annotated Code of Maryland (1966 Replacement Volume and 1972
Interim Supplement), title "Courts," subtitle "Juvenile Causes," and to repeal
and re-enact, with amendments, Section 145 (b) (1) of Article 26 of the
Annotated Code of Maryland (1966 Replacement Volume and 1972
Supplement), title "Courts," subtitle "District Courts," to transfer jurisdiction
of certain offenses of the Maryland Boat Act and regulations adopted pursuant
thereto under Article 14B of the Annotated Code from the Juvenile Court to the
District Court.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 70-2 (d) (2) of Article 26 of the Annotated Code of
Maryland (1966 Replacement Volume and 1972 Interim Supplement), title
"Courts," subtitle "Juvenile Causes," be and it is hereby repealed and re-enacted,
with amendments, to read as follows:

70-2.

(d) (2) A proceeding involving a child who has reached his 16th birthday,
alleged to have done an act in violation of any provision of Article 66-1/2 or any
other traffic law or ordinance (other than manslaughter by automobile, possession
of a stolen motor vehicle, unauthorized use or occupancy of a motor vehicle,
tampering with a motor vehicle, or a violation of Section 11-902 of Article
66-l/2)[[[.]]] , AND A PROCEEDING INVOLVING A CHILD WHO HAS
REACHED HIS 16TH BIRTHDAY ALLEGED TO HAVE DONE AN ACT
IN VIOLATION OF ANY PROVISION OF ARTICLE 14B OR RULES AND
REGULATIONS ADOPTED PURSUANT THERETO (OTHER THAN
MANSLAUGHTER BY BOAT, POSSESSION OF A STOLEN BOAT,
UNAUTHORIZED USE OR OCCUPANCY OF A BOAT, TAMPERING
WITH A BOAT OR OPERATING A BOAT UNDER THE INFLUENCE OF
INTOXICATING LIQUOR OR DRUGS).

SECTION 2. AND BE IT FURTHER ENACTED BY THE GENERAL
ASSEMBLY OF MARYLAND, That Section 145 (b) (1) of Article 26 of the
Annotated Code of Maryland (1966 Replacement Volume and [[1972]] 1971
Supplement), title "Courts," subtitle "District Courts," be and it is hereby
repealed and re-enacted, with amendments, to read as follows:

145.

(b) (1) Traffic. The District Court shall have jurisdiction to hear, try and
determine the case of any person who has attained his sixteenth (16th) birthday, or
of any corporation, charged with the commission of an offense arising under
Article 66-1/2 of the Annotated Code of Maryland (1957 Edition, as amended),
generally known as the Vehicle Law, except for any offense therein specifically
designated as a felony and except for the offenses specifically enumerated in
Article 26, Section 70-2 (d) (2) of the Annotated Code of Maryland, 1957 Edition,
as amended[.] , AND THE CASE OF ANY PERSON WHO HAS REACHED
HIS SIXTEENTH (16TH) BIRTHDAY ALLEGED TO HAVE DONE AN
