(House Bill 43)
AN ACT to repeal and re-enact, with amendments, Section 61 of Article 89 of the
Annotated Code of Maryland (1969 Replacement Volume), title "Department
of Labor and Industry," subtitle "High-Voltage Line Act," to enlarge upon the
requirements of warning signs which must be placed on certain equipment
operated within a certain distance of high-voltage lines and to change the
arrangement of this section.
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 61 of Article 89 of the Annotated Code of Maryland
(1969 Replacement Volume), title "Department of Labor and Industry," subtitle
"High-Voltage Line Act," be and it is hereby repealed and re-enacted, with
amendments, to read as follows:
61.
(A) When any such operation, erection, handling, storage, transportation, or
moving is to be performed within ten feet of any high-voltage lines, the person or
persons responsible for performing the same shall promptly notify the owner or
operator of the high-voltage lines of the work to be performed and such person or
persons shall be responsible for the provision, subject to any necessary agreement
of the owner or operator of the high-voltage lines, of one or more of the safety
measures required by Section 60 of this article before proceeding with any work
within said ten feet.
(B) Upon notification and appropriate arrangements being made by such person
or persons, and within a reasonable time thereafter under all the circumstances
involved, the owner or operator of the high-voltage lines shall perform such acts as
are reasonably necessary for such owner or operator to perform, as set forth in and
subject to the provisions of Section 60 hereof, to guard against danger from
accidental contact.
(C) It shall be the duty and responsibility of the owner, lessee or employer of
any equipment, including but not limited to cranes, derricks, power shovels,
trimming rigs, pile drivers or similar apparatus, any part of which may be used
near any high-voltage lines, to:
[[A.]] (1) Acquaint themselves and their employees with this law and the
rules and regulations prescribed and promulgated pursuant to Section 62 hereof,
and;
[[B. Post and maintain in plain]] (2) POST AND MAINTAIN IN CLEAR
view of the operators of such equipment a permanent, weather resistant warning
sign, legible at 12 feet, reading "unlawful to operate this equipment within 10 feet of
any electric wire."
(D) [[THIS SIGN MUST BE IN CLEAR VIEW OF THE OPERATOR
WHEN HE IS AT THE CONTROLS OF THE EQUIPMENT. IN ADDITION,
THIS SAME SIGN MUST ALSO BE PLACED ON THE BOOM OF ANY
CRANE OR DERRICK IN SUCH A MANNER THAT WHEN THE BOOM
