182                                        LAWS OF MARYLAND                                Ch. 116

(c)  The State Department of Health may enter into appropriate agreements with
any other agency of the State or its political subdivisions for the enforcement of
the provisions of this section.

(d)  The provisions of this section shall not apply in any political subdivision
which has adopted, as part of its building code, standards no less stringent than the
standards adopted by the State Department of Health.

(e)  Any person who violates the provisions of this section shall be guilty of a
misdemeanor, and upon conviction shall be subject to a fine not to exceed fifty
dollars ($50.00) for each offense. ]

SECTION 2. AND BE IT FURTHER ENACTED, That new Sections
[[226FF-1 through 226FF-6]] 266GG-1 through 266GG-6 be and they are hereby
added to Article 41 of the Code, title "Governor-Executive and Administrative
Departments,'" subtitle "Department of Economic and Community Development,"'
to follow immediately after Section [[226EE-6]] 266FF-6 thereof and to be under
the new subheading "Safety Glazing," and all to read as follows:

SAFETY GLAZING

[[226FF-l.]] 266GG-1.

AS USED IN THIS SUBHEADING:

(1)     "SAFETY GLAZING MATERIAL" MEANS ANY GLAZING
MATERIAL, SUCH AS TEMPERED GLASS, LAMINATED GLASS, WIRE
GLASS OR RIGID PLASTIC, WHICH MEETS THE TEST
REQUIREMENTS OF THE AMERICAN NATIONAL STANDARDS
INSTITUTE STANDARD ANSI Z-97.1-1971, OR AS MAY BE AMENDED,
AND SUCH FURTHER REQUIREMENTS AS MAY BE ADOPTED BY
THE STATE DEPARTMENT OF ECONOMIC AND COMMUNITY
DEVELOPMENT AFTER NOTICE AND HEARING AS REQUIRED BY
THE ADMINISTRATIVE PROCEDURE ACT AND WHICH ARE SO
CONSTRUCTED, TREATED, OR COMBINED WITH OTHER
MATERIALS AS TO MINIMIZE THE LIKELIHOOD OF CUTTING AND
PIERCING INJURIES RESULTING FROM HUMAN CONTACT WITH
THE GLAZING MATERIAL.

(2)  "HAZARDOUS LOCATIONS'" MEANS LOCATIONS SUCH AS EXIT
DOORS (FRAMED OR UNFRAMED), STORM DOORS, EXCEPT
OPERATING VENTS ONLY_ ON JALOUSIE DOORS, SLIDING DOORS
(BOTH FIXED AND SLIDING DOORS), SHOWER DOORS, TUB
ENCLOSURES AND FIXED GLAZED PANELS IMMEDIATELY
ADJACENT TO EXIT DOORS WHICH MAY BE MISTAKEN FOR MEANS
OF EGRESS OR INGRESS, IN RESIDENTIAL, INDUSTRIAL,
COMMERCIAL, INSTITUTIONAL OR PUBLIC BUILDINGS; AND ANY
OTHER ELEMENTS, GLAZED OR TO BE GLAZED, WHEREIN THE USE
OF OTHER THAN SAFETY GLAZING MATERIALS WOULD
CONSTITUTE AN UNREASONABLE HAZARD AS THE SECRETARY OF
THE STATE DEPARTMENT OF ECONOMIC AND COMMUNITY
DEVELOPMENT MAY DETERMINE AFTER NOTICE AND HEARINGS
AS REQUIRED BY THE STATE ADMINISTRATIVE PROCEDURE ACT;
WHETHER OR NOT THE GLAZING IN THE DOORS, PANELS,
ENCLOSURES AND OTHER ELEMENTS IS TRANSPARENT.
