AN ACT relating to The Maryland-National Capital Park and Planning
Commission to add a new Article 63(e) to Chapter 780 of the Laws of
Maryland, 1959, as amended, being also a new Section 70-74(e) to the
Montgomery County Code (1965 Edition, as amended), and a new Section
59-68(e) to the Code of Public Local Laws of Prince George's County (1963
Edition, as amended), being Articles 16 and 17, respectively, of the Code of
Public Local Laws of Maryland, titles "Montgomery County" and "Prince
George's County," subtitle "Park and Planning Commission," to follow
immediately after Article 63(d) of Chapter 780 of the Laws of Maryland, as
amended, being also Sections 70-74(d) and 59-68(d) of the respective County
Codes, and to repeal and re-enact, with amendments, Article 75 of Chapter 780,
Laws of Maryland, 1959, as amended, being also Section 70-86 of the
Montgomery County Code (1965 Edition, as amended) and Section 59-80 of the
Code of Public Local Laws of Prince George's County (1963 Edition, as
amended), being Articles 16 and 17, respectively, of the Code of Public Local
Laws of Maryland, titles "Montgomery County" and "Prince George's
County," subtitle "Park and Planning Commission," authorizing The
Maryland-National Capital Park and Planning Commission to make and adopt
a plan designating sites, structures with their appurtenances and environmental
settings, or districts having historical, archeological, architectural or cultural
value within the Regional District, requiring that the criteria for such
designation or identification shall not be inconsistent with the criteria applicable
to the Maryland Historical Trust, authorizing the Commission to establish
advisory committees to assist it in the performance of its duties, providing that
such plan shall become an amendment to the General Plan for the
Maryland-Washington Regional District and, under certain circumstances, may
include sites, structures with their appurtenances and environmental settings, or
districts within municipalities in Montgomery and Prince George's Counties not
subject to the jurisdiction of the Commission, authorizing the respective District
Councils of Montgomery and Prince George's Counties to enact appropriate
rules and regulations for the protection, preservation and enhancement of such
sites, structures or districts, and requiring the District Councils to provide for
just compensation where the application of such rules and regulations
constitutes a taking of private property.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That new Article 63(e) be and is hereby added to Chapter 780,
Laws of Maryland, 1959, as amended, and that new Section 70-74(e) be and is
hereby added to the Montgomery County Code (1965 Edition, as amended) and
new Section 59-68(e) be and is hereby added to the Code of Public Local Laws of
Prince George's County (1963 Edition, as amended), being Articles 16 and 17,
respectively, of the Code of Public Local Laws of Maryland, titles "Montgomery
County" and "Prince George's County," subtitle "Park and Planning
Commission," to follow immediately after Article 63(d) of Chapter 780 of the
Laws of Maryland, 1959, as amended, being also Sections 70-74(d) and 59-68(d) of
the respective County Codes; and Article 75 of Chapter 780 of the Laws of
Maryland, 1959, as amended, being also Section 70-86 of the Montgomery County
Code (1965 Edition, as amended) and Section 59-80 of the Code of Public Local
Laws of Prince George's County (1963 Edition, as amended), being Articles 16 and
17, respectively of the Code of Public Local Laws of Maryland, titles
"Montgomery County" and "Prince George's County," subtitle "Park and
Planning Commission," be and the same are hereby repealed and re-enacted, with
amendments, to read as follows:
