CHAPTER 847
(House Bill 1174)

AN ACT to repeal and re-enact, with amendments, Section 19(e) of Article 38 A of
the Annotated Code of Maryland (1971 Replacement Volume), title "Fires and
Investigations," subtitle "Fireworks," [[to eliminate certain storage
requirements for certain Class B fireworks and to require the issuance of a
permit to store Class B fireworks upon the State Fire Marshal's approval of the
storage facilities.]] to provide for storage of certain Class B fireworks under
certain circumstances at certain times and to restrict storage of Class B
fireworks at certain times except under certain conditions.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 19(e) of Article 38A of the Annotated Code of
Maryland (1971 Replacement Volume), title "Fires and Investigations," subtitle
"Fireworks," be and it is hereby repealed and re-enacted, with amendments, to
read as follows:

19.

(e) A license to manufacture fireworks, granted pursuant to this section, permits
the licensee to manufacture, process, and store Class C fireworks, and rockets and
Roman candles as hereinafter permitted. The manufacture of any Class B display
fireworks, fireworks commonly known as "flash and sound," products utilizing
potassium chlorate, and any explosives, including Class B special fireworks other
than rockets and Roman candles, is unlawful, except as authorized by any other
law. The storage of Class B fireworks other than rockets or Roman candles is
prohibited except as permitted by this subsection. Class B fireworks [[]]]for
authorized displays[[]]] may be stored in a separate storage building approved by
the State Fire Marshal upon obtaining a permit from the State Fire Marshal.
[[UPON APPROVAL OF THE STORAGE FACILITIES, A PERMIT SHALL
BE ISSUED.]] [[[]] The State Fire Marshall may issue a permit for the storage
of Class B display fireworks for only that material for which the applicant has
valid orders, and the permits shall specify the type and quantity of Class B
material and order number. A permit for storage may be issued for a period not to
extend beyond the date of the authorized display and in no case to exceed ten
days[[]]] HOWEVER. CLASS B FIREWORKS MAY BE STORED IN A
SEPARATE STORAGE BUILDING BETWEEN APRIL 20 AND JULY 20
INCLUSIVE. WITHOUT VALID ORDERS, IF THE STATE ARE
MARSHAL ISSUES A PERMIT. [[THE STATE FIRE MARSHAL SHALL
ISSUE THE PERMIT ONLY IF THE STORAGE FACILITIES ARE
APPROVED AS PROVIDED BY THE APPLICABLE REGULATIONS.]]
Any person violating this subsection is guilty of a misdemeanor and upon
conviction shall be fined not more than $1,000.00 or imprisoned for not more than
one year, or both.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1973.
