1700                                   LAWS OF MARYLAND                                Ch. 829

(1)  A DEED TO THE CONDOMINIUM UNIT HAS BEEN CONVEYED
TO THE PURCHASER AND RECORDED WITH THE COURT IN WHICH
THE DEPOSIT IS HELD;

(2)  THE PURCHASER, HIS HEIRS OR ASSIGNS HAVE RECEIVED A
REFUND OF THE DEPOSIT FROM THE DEVELOPER OR SELLER:

(3)  THE DEPOSIT HAS BEEN FORFEITED BY THE PURCHASER, HIS
HEIRS OR ASSIGNS UNDER THE TERMS OF THE CONTRACT OF
SALE RELATING TO THE PURCHASE OF THE CONDOMINIUM UNIT;

(4) THE DEVELOPER OR. SELLER FAILS TO COMPLETE THE
CONSTRUCTION OF THE CONDOMINIUM UNIT AND THE
PURCHASER BECOMES ENTITLED TO A RETURN OF HIS DEPOSIT.

(C) FAILURE TO DEPOSIT MONEYS GIVEN TO A DEVELOPER OR
SELLER IN ACCORDANCE WITH THE PROVISIONS OF SUBSECTION
(A) OF THIS SECTION IS A MISDEMEANOR AND IS PUNISHABLE
UPON CONVICTION BY A FINE NOT TO EXCEED $500 OR
IMPRISONMENT NOT TO EXCEED SIX MONTHS, OR BOTH. IN CASES
OF A VIOLATION BY A CORPORATION, ANY OFFICER, DIRECTOR,
OR EMPLOYEE OF THE CORPORATION WHO KNOWINGLY
PARTICIPATED IN ANY ACT OR OMISSION WHICH IS PART OF THE
VIOLATION IS SUBJECT TO THE PENALTIES OF THIS SUBSECTION
(C).

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall take
effect July 1, 1973.

CHAPTER 829
(House Bill 1011)

AN ACT to repeal and re-enact, with amendments, Section 118 of Article 27 of
the Annotated Code of Maryland (1971 Replacement Volume), title "Crimes
and Punishments," subtitle "I. Crimes and Punishments," subheading
"Destroying, Injuring, etc., Property Maliciously," to provide that the
provisions of the Section which apply to certain acts committed on the property
of water supply companies shall apply to publicly owned water supply
companies in Washington County, and to add appropriate lettering.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section 118 of Article 27 of the Annotated Code of
Maryland (1971 Replacement Volume), title "Crimes and Punishments," subtitle
"I. Crimes and Punishments," subheading "Destroying, Injuring, etc., Property
Maliciously," is hereby repealed and re-enacted, with amendments, to read as
follows:

118.

(A) It shall be unlawful for any person or persons to wrongfully and maliciously
connect, disconnect, tap or interfere or tamper with any of the canals, springs,
reservoirs, tunnels, mounds, dams, plugs, mains, pipes, conduits, connections, taps,
