[[[[](h)[[]]] [(B) The SUPERVISOR OF ASSESSMENTS FOR EACH
COUNTY AND BALTIMORE CITY [county commissioners or county council]
shall submit to the State Department of Assessments and Taxation, from the
applicants for each position to be filled, a list of not less than three applicants for
each position, [provided, however, that in Montgomery County the list of
applicants shall be submitted by the county executive with the approval of the
county council]. The State Department of Assessments and Taxation WITH THE
ASSISTANCE OF THE DEPARTMENT OF PERSONNEL shall interview,
examine and grade said applicants, in order to determine their relative
qualifications for the position or positions to be filled, and shall certify the list of
applicants and their respective grades to the SUPERVISOR OF ASSESSMENTS
FOR EACH COUNTY AND BALTIMORE CITY [county commissioners or
county council, and the county executive of Montgomery County], who shall
appoint an assessor (by whatever title designated) for each position from the [said]
list, (provided, however, that all appointments by the county executive of
Montgomery County shall be subject to the confirmation of the county council].
In the event of the resignation, death or removal of any assessor, the vacancy shall
be filled [by the county commissioners or county council and the county executive
of Montgomery County in the manner hereinbefore set forth,] within 60 days from
the date when the vacancy occurs. [The annual salaries of the county assessors and
all other expenses incident to local assessment shall be levied for and paid by the
several boards of county commissioners and county councils. After July 1, 1961,
assessors (by whatever title designated) shall not hold their positions after they
have attained the age of seventy years (70).] UPON THE REQUEST OF THE
COUNTY COMMISSIONERS, OR COUNTY COUNCIL, OR COUNTY
EXECUTIVE IF ANY, THE SUPERVISORS SHALL FURNISH THE
NAMES OF THE APPLICANTS SUBMITTED FOR ANY ASSESSING
POSITION.
[(i)] (C) [The] NOTWITHSTANDING ANY LOCAL LAW OR
ORDINANCE, THE assessors in Baltimore City, (by whatever title designated),
shall be appointed las provided by local law or ordinance, but before any assessor
shall be appointed, the officer making such appointment shall submit the lists of
names from which said appointment or appointments are to be made to the State
Department of Assessments and Taxation for certification by said Department, as
provided relative to the appointment of assessors in the several counties] IN THE
SAME MANNER AS PROVIDED FOR THE COUNTIES IN SUBSECTION
(B).
The State Department of Assessments and Taxation shall have the same right
of removal of assessors in Baltimore City as it has of assessors in the counties,
with the right of appeal of any assessors so removed to the city service commission
of Baltimore City.
[(j)] (D) Upon appointment, each assessor shall perform his duties under the
direction of the supervisor of assessments of the county or of the director of the
department of assessments of Baltimore City, as the case may be, and shall hold
his position during good behavior, subject only to removal by the State
Department of Assessments and Taxation after hearing for incompetency or other
cause. ]]
(A) THE SUPERVISOR OF ASSESSMENTS SHALL BE ALLOWED
SUCH PROFESSIONAL ASSESSING PERSONNEL AS IS PROVIDED IN
THE ANNUAL BUDGET.
[(k) Nothing herein shall affect the powers and duties of the department of
assessments in Baltimore City, as prescribed by local law and ordinance.]
