1454                                     LAWS OF MARYLAND                                 Ch. 695

(D)  THAT PROCEDURES ESTABLISHED FOR USE IN PROGRAMS,
FACILITIES, AND PROJECTS BE ACCURATE, PROVIDE MAXIMUM
INFORMATION,         AND          BE          SUBJECT TO         MINIMUM
MISINTERPRETATION, AND THAT THESE PROCEDURES BE
REGULARLY SUBJECTED TO REVIEW;

(E)    THAT NO TEST OR TESTS BE PERFORMED ON ANY
INDIVIDUAL OVER 18 YEARS OF AGE OVER THE OBJECTION OF
ANY SUCH INDIVIDUAL OR [[HIS LEGAL]] ANY INDIVIDUAL
UNDER 18 OR AN INCOMPETENT OVER THE OBJECTIONS OF HIS
PARENT OR GUARDIAN AND THAT NO TEST OR TESTS BE
PERFORMED UNLESS SUCH INDIVIDUAL, PARENT OR [[HIS
LEGAL]] GUARDIAN IS FULLY INFORMED OF THE PURPOSE OR
PURPOSES OF TESTING FOR HEREDITARY DISORDERS AND THE
CARRIER STATE OF HEREDITARY DISORDERS, AND IS GIVEN A
REASONABLE OPPORTUNITY TO OBJECT TO SUCH TESTING;

(F)         THAT NO PROGRAM REQUIRE MANDATORY
PARTICIPATION, RESTRICTION OF CHILDBEARING, OR BE A
PREREQUISITE TO ELIGIBILITY FOR, OR RECEIPT OF ANY OTHER
SERVICE OR ASSISTANCE FROM OR TO PARTICIPATION IN ANY
OTHER PROGRAM;

(G)       THAT COUNSELING SERVICES FOR HEREDITARY
DISORDERS BE AVAILABLE TO ALL PERSONS INVOLVED IN
SCREENING PROGRAMS, THAT SUCH COUNSELING BE
NON-DIRECTIVE; AND THAT SUCH COUNSELING EMPHASIZE
INFORMING THE CLIENT AND NOT REQUIRE RESTRICTION OF
CHILDBEARING;

(H) THAT ALL PARTICIPANTS IN PROGRAMS ON HEREDITARY
DISORDERS BE PROTECTED FROM UNDUE PHYSICAL OR MENTAL
HARM, BE INFORMED OF THE NATURE OF RISKS INVOLVED IN
PARTICIPATION IN SUCH A PROGRAM OR PROJECT, BE INFORMED
OF THE NATURE AND COST OF AVAILABLE THERAPIES OR
MAINTENANCE PROGRAMS FOR THOSE AFFECTED BY
HEREDITARY DISORDERS, AND BE INFORMED OF THE POSSIBLE
BENEFITS AND RISKS OF SUCH THERAPIES AND PROGRAMS;

(I) THAT ALL UNAMBIGUOUS DIAGNOSTIC RESULTS BE MADE
AVAILABLE TO THE INDIVIDUAL OVER 18 YEARS OF AGE OR [[HIS
LEGAL]] IF THE INDIVIDUAL IS UNDER 18 OR AN INCOMPETENT
TO HIS PARENT OR GUARDIAN, THROUGH A PHYSICIAN OR
OTHER SOURCE OF HEALTH CARE; AND THAT ALL INFORMATION
OBTAINED FROM ANY INDIVIDUAL, OR FROM SPECIMENS FROM
ANY INDIVIDUAL BE HELD CONFIDENTIAL AND BE CONSIDERED A
CONFIDENTIAL MEDICAL RECORD EXCEPT FOR SUCH
INFORMATION AS THE INDIVIDUAL [[OR HIS LEGAL]], PARENT
OR. GUARDIAN CONSENTS TO BE RELEASED, PROVIDED THAT THE
INDIVIDUAL IS INFORMED OF THE SCOPE OF THE INFORMATION
REQUESTED TO BE RELEASED AND THE PURPOSE OR PURPOSES
FOR RELEASING SUCH INFORMATION; AND EXCEPT FOR
STATISTICAL DATA COMPILED WITHOUT REFERENCE TO THE
IDENTITY OF ANY INDIVIDUAL;

(J) THAT ALL INFORMATION GATHERED BY THE COMMISSION,
OR BY OTHER AGENCIES, ENTITIES AND INDIVIDUALS
CONDUCTING PROGRAMS AND PROJECTS ON HEREDITARY
