[[(D)]] (4) RE-EVALUATE ON A CONTINUOUS BASIS THE NEED
FOR AND EFFICACY OF STATE PROGRAMS ON HEREDITARY
DISORDERS;

[[(E)]] (5) INVESTIGATE UNJUSTIFIED DISCRIMINATION
RESULTING FROM IDENTIFICATION AS A CARRIER OF A
HEREDITARY DISORDER, AND MAKE RECOMMENDATIONS AS IT
DEEMS NECESSARY TO END SUCH UNJUSTIFIED DISCRIMINATION.
SUCH POWERS TO INVESTIGATE DISCRIMINATION RESULTING
FROM IDENTIFICATION AS A CARRIER OF A HEREDITARY
DISORDER SHALL NOT PRECLUDE, OR NEED TO BE ANTECEDENT
TO, ANY PERSON OR GROUP OF PERSONS SEEKING REDRESS
THROUGH ANY OTHER MEANS.

(B) FOR THE PURPOSES OF THIS SUBTITLE, HEREDITARY
DISORDER MEANS ANY DISORDER RESULTANT FROM THE
GENETIC MATERIAL DNA (DEOXYRIBONUCLEIC ACID) WHICH IS
TRANSMITTED FROM A PARENT OR PARENTS TO HIS OR HER

THE RULES, REGULATIONS, AND STANDARDS ESTABLISHED
AND PROMULGATED BY THE COMMISSION SHALL BE IN ACCORD
WITH THE PRINCIPLES ESTABLISHED HEREIN. THE COMMISSION
MAY ESTABLISH SUCH OTHER PRINCIPLES NOT CONTRARY TO
THOSE ESTABLISHED HEREUNDER AS IT DEEMS NECESSARY TO
PROMOTE AND PROTECT THE PUBLIC HEALTH AND SAFETY. SUCH
PRINCIPLES SHALL INCLUDE:

[[(A) THAT THE PROGRAMS SUBJECT TO RULES,
REGULATIONS, AND STANDARDS ESTABLISHED BY THE
COMMISSION HAVE AN ATTAINABLE AND REALISTIC PURPOSE
WHICH WILL FURTHER PROMOTE THE PUBLIC HEALTH AND
WELFARE; ]]

[[(B)]] (A) THAT THE PUBLIC, ESPECIALLY COMMUNITIES AND
GROUPS OF PERSONS PARTICULARLY AFFECTED BY PROGRAMS
ON HEREDITARY DISORDERS, HAS BEEN CONSULTED BEFORE ANY
RULES, REGULATIONS, AND STANDARDS ARE ADOPTED BY THE
COMMISSION;

(B) THAT THE INCIDENCE OF EACH HEREDITARY DISORDER
AND THE COST OF DETECTION AND MANAGEMENT OF EACH
HEREDITARY DISORDER BE CONSIDERED BY THE COMMISSION;
AND THAT WHERE APPROPRIATE, STATE AND NATIONAL EXPERTS
IN THE MEDICAL, PSYCHOLOGICAL, ETHICAL, SOCIAL, AND
ECONOMIC EFFECTS OF PROGRAMS FOR THE DETECTION AND
MANAGEMENT OF HEREDITARY DISORDERS BE CONSULTED BY
THE COMMISSION.

(C) THAT INFORMATION ON THE OPERATION OF ALL
PROGRAMS ON HEREDITARY DISORDERS WITHIN THE STATE,
EXCEPT FOR CONFIDENTIAL INFORMATION OBTAINED FROM
PARTICIPANTS IN SUCH PROGRAMS, BE OPEN AND FREELY
AVAILABLE TO THE PUBLIC;
