DISORDERS, OTHER THAN STATISTICAL INFORMATION AND
INFORMATION WHICH THE INDIVIDUAL ALLOWS TO BE RELEASED
THROUGH HIS INFORMED CONSENT, BE KEPT IN CODE; AND THAT
PUBLIC AND PRIVATE ACCESS TO INDIVIDUAL PATIENT DATA BE
LIMITED TO DATA COMPILED WITHOUT THE INDIVIDUAL'S NAME.

THE COMMISSION SHALL SUBMIT TO THE GOVERNOR AND THE
LEGISLATURE ON AN ANNUAL BASIS BEGINNING JANUARY 1 OF
THE FIRST YEAR FOLLOWING THE EFFECTIVE DATE OF THIS
SUBTITLE, AND ON EACH JANUARY 1 THEREAFTER, A REPORT
SUMMARIZING THE ACTIVITIES OF THE COMMISSION, AND
CONTAINING ANY RECOMMENDATIONS TO THE GOVERNOR AND
THE LEGISLATURE WHICH THE COMMISSION DEEMS NECESSARY
REGARDING PROBLEMS OF HEREDITARY DISORDERS.

815.

THE SECRETARY OF THE DEPARTMENT OF HEALTH AND
MENTAL HYGIENE SHALL DESIGNATE SUCH PERSONNEL AS IS
NECESSARY TO CARRY OUT THE PROVISIONS OF THIS SUBTITLE.
THE SECRETARY SHALL BE RESPONSIBLE FOR:

(A)  THE OPERATION OF PROGRAMS WITHIN THE STANDARDS
SET BY THE COMMISSION;

(B)  THE DISBURSEMENT AND COLLECTION OF SUCH FUNDS AS
ARE AVAILABLE TO THE COMMISSION;

(C)    ENFORCING RULES, REGULATIONS, AND STANDARDS
ESTABLISHED BY THE COMMISSION; AND

(D)    KEEPING THE COMMISSION INFORMED, THROUGH ITS
EXECUTIVE DIRECTOR, OF THE PROGRESS OF PROGRAMS AND OF
ANY NEED FOR CHANGES IN RULES AND REGULATIONS. ONLY
THE COMMISSION MAY MAKE RULES AND REGULATIONS.

816.

AN APPROPRIATION OF FUNDS SHALL BE MADE EACH YEAR AS
NECESSARY TO CARRY OUT THE DUTIES OF THE COMMISSION.

Article 43
[33A.
(a) For the purposes of this section:

(1)  "Sickle cell anemia" shall mean the hereditary disease causing hemoglobin
to crystallize within the red blood cells upon their emitting of oxygen;

(2)  "Sickle cell trait" shall mean the condition caused by the presence of the
inheritable gene which, if present in both parties to a marriage, shall lead to a high
probability of the occurrence of sickle cell anemia in children born of that
marriage;

(3)  "Secretary" shall mean the Secretary of Health and Mental Hygiene.
