tuition waiver regulations in effect prior to that date. Other students who possess
the prescribed qualifications may be admitted in the discretion of the board of
trustees on payment of such fees and tuition charges as determined by the board.
THE BOARD OF TRUSTEES OF STATE COLLEGES [[MAY]] SHALL
SET TUITION AND FEES FOR THE UNDERGRADUATE, GRADUATE
AND PROFESSIONAL SCHOOLS AND OTHER APPROPRIATE
DIVISIONS OF THE UNIVERSITY OF BALTIMORE, APPLICABLE
ONLY TO THE UNIVERSITY OF BALTIMORE.

THE BOARD OF TRUSTEES OF THE STATE COLLEGES [[MAY]]
SHALL ENTER INTO AN AGREEMENT WITH THE BOARD OF
TRUSTEES OF THE UNIVERSITY OF BALTIMORE FOR THE PURPOSE
OF TRANSFERRING ALL OF THE PROPERTY AND ASSETS OF THE
UNIVERSITY OF BALTIMORE TO THE BOARD OF TRUSTEES OF
STATE COLLEGES, INCLUDING ANY AND ALL CREDITS AND
RIGHTS AND ALL LIABILITIES AND OBLIGATIONS OF THE
UNIVERSITY OF BALTIMORE. THE BOARD OF TRUSTEES OF THE
STATE COLLEGES, UPON EXECUTION OF SAID AGREEMENT, SHALL
ACCEPT A DEED OF CONVEYANCE FOR THE REAL PROPERTY, AND
ALL OTHER PROPERTY, ASSETS, CREDITS AND RIGHTS, AND ALL
LIABILITIES AND OBLIGATIONS COVERED BY SAID AGREEMENT
AND HEREIN OR HEREAFTER GRANTED TO THE BOARD OF
TRUSTEES OF THE STATE COLLEGES, AND SHALL HAVE AND HOLD
AND USE THE SAME IN ORDER TO PROVIDE FOR THE EDUCATION
OF STUDENTS IN COLLEGIATE OR POST GRADUATE STUDIES,
UPON COMPLETION OF THIS TRANSFER, THE BOARD OF TRUSTEES
OF THE UNIVERSITY OF BALTIMORE SHALL BE ABOLISHED AND A
BOARD OF VISITORS SHALL BE APPOINTED FOR THE UNIVERSITY
AS PROVIDED IN SECTION 12-1 OF THIS ARTICLE.
14M.
(A) THE BOARD OF TRUSTEES OF THE STATE COLLEGES SHALL
DESIGNATE THE UNIVERSITY OF BALTIMORE AS AN UPPER
DIVISION ACADEMIC INSTITUTION. THAT IS, THIRD AND FOURTH
COLLEGIATE YEAR AND POST GRADUATE STUDIES, WHICH SHALL
ACCOMMODATE BUT NOT BE RESTRICTED TO, STUDENTS
TRANSFERRING FROM ANY MARYLAND STATE COLLEGE OR
MARYLAND STATE COMMUNITY COLLEGE.
(B) THE UNIVERSITY OF BALTIMORE SHALL OFFER SUCH
PROFESSIONAL SCHOOLS AND GRADUATE PROGRAMS AS
APPROVED BY THE BOARD OF TRUSTEES OF THE STATE COLLEGES
AND THE MARYLAND COUNCIL FOR HIGHER EDUCATION.
(C) IT IS THE INTENTION OF THE GENERAL ASSEMBLY THAT
THE UNIVERSITY OF BALTIMORE IS AN EDUCATIONAL
INSTITUTION WITHIN THE PROVISIONS OF THIS SECTION FOR
COMMUTING STUDENTS, AND TO THIS END, NO PUBLIC FUNDS
MAY BE USED FOR THE CONSTRUCTION OF DORMITORY
FACILITIES FOR THE UNIVERSITY.
SEC. 2. AND BE IT FURTHER ENACTED, That [[this Act shall take effect
July 1, 1974]], Notwithstanding the effective date of this Act and its transitional
provisions, it is the legislative intent that the University of Baltimore shall become
an operational State educational institution on January 1, 1975, if prior to July 1,
