(4) THE BENEFITS OF ALL MARYLAND STATE PROGRAMS FOR
CAPITAL DEVELOPMENT AND IMPROVEMENT SHALL BE
AVAILABLE TO THE UNIVERSITY UNDER TERMS AND CONDITIONS
COMPARABLE TO THOSE APPLICABLE TO LAND GRANT
INSTITUTIONS OF HIGHER LEARNING AND STATE COLLEGES. IN
ACCORDANCE WITH LEGISLATIVE APPROPRIATIONS MADE AS
PROVIDED BY LAW, THE STATE MAY, BY AGREEMENT WITH THE
BOARD OF TRUSTEES AND THE APPROVAL OF THE BOARD OF
PUBLIC WORKS ACQUIRE LANDS, ERECT AND EQUIP BUILDINGS
AND PROVIDE FACILITIES FOR THE USE OF THE UNIVERSITY.
(5) THE UNIVERSITY OF BALTIMORE SHALL RECEIVE SUCH
ADDITIONAL FISCAL SUPPORT AS APPROPRIATED BY THE
GENERAL ASSEMBLY AND PROVIDED BY THE ANNUAL OPERATING
BUDGET OF THE STATE OF MARYLAND.
(6) SALARIES OF THE FACULTY SHALL MEET THE AVERAGE OF
THOSE PAID BY OTHER MARYLAND STATE INSTITUTIONS OF
HIGHER EDUCATION. SALARIES OF THE FACULTY OF THE
COLLEGE OF LAW SHALL MEET THE AVERAGE OF SUCH SALARIES
AS ESTABLISHED BY THE AMERICAN BAR ASSOCIATION.
(7) THE LEGISLATIVE AUDITOR SHALL ANNUALLY AUDIT ALL
EXPENDITURES AND ACCOUNTS OF THE UNIVERSITY AND REPORT
TO THE LEGISLATURE ABOUT SAME.
(8) IT IS THE DUTY AND FUNCTION OF THE MARYLAND
COUNCIL OF HIGHER EDUCATION TO PROVIDE THE ACADEMIC
PROGRAM APPROVAL TO SUCH UNIVERSITY DEFINED IN SECTION
30A OF ARTICLE 77A OF THIS ACT.

FOR THE PURPOSES OF THIS SUBTITLE, PUBLIC HIGHER
EDUCATION IN THIS STATE SHALL INCLUDE THE UNIVERSITY OF
BALTIMORE.]]

(a) There is hereby established a board of trustees to be known as the board of
trustees of the State colleges which shall exercise direction and control of the
public colleges of the State: Morgan State College. State Teachers College at
Bowie, Coppin State Teachers College in Baltimore City, State Teachers College
at Frostburg, State Teachers College at Salisbury, State Teachers College at
Towson, THE UNIVERSITY OF BALTIMORE, and any other State college
offering a four-year course of study that may hereafter be established. WITH THE
EXCEPTION OF THE UNIVERSITY OF BALTIMORE WHICH SHALL BE
DESIGNATED AS AN UPPER DIVISION ACADEMIC INSTITUTION AS
HEREINAFTER PROVIDED. Each "State teachers college" shall henceforth be
officially known and referred to as "State college".
(g) Students regularly admitted to or enrolled in any class at the State colleges
from the City of Baltimore and the several counties who shall obligate themselves
to teach in the public schools of the State of Maryland, shall not be required to
pay any tuition fees. This tuition waiver shall not apply after October 1, 1972.
