SUCCESSORS SHALL SERVE FOR A TERM OF THREE YEARS.
ELEVEN SHALL BE ELECTED BY THE BOARD, THE MEMBERS TO
SERVE THEIR TERMS IN THE SAME MANNER AS THOSE
APPOINTED BY THE GOVERNOR. AT LEAST ELEVEN FIRST ELECTED
BY THE BOARD SHALL BE SELECTED FROM THE PRESENT BOARD
OF TRUSTEES OF THE UNIVERSITY OF BALTIMORE. IN CASE OF A
VACANCY FROM DEATH, RESIGNATION OR OTHERWISE, IT SHALL
BE FILLED BY APPOINTMENT OR ELECTION, WHICHEVER IS
APPROPRIATE, FOR THE UNEXPIRED TERM OF THE MEMBER
CAUSING THE VACANCY. NO PERSON SHALL SERVE FOR MORE
THAN THREE CONSECUTIVE TERMS. THE BOARD SHALL ELECT
ANNUALLY, A CHAIRMAN FROM ITS MEMBERSHIP. THE
PRESIDENT OF THE UNIVERSITY OF BALTIMORE SHALL BE AN
EX-OFFICIO MEMBER OF THE BOARD.
(B) MEMBERS OF THE BOARD SHALL SERVE WITHOUT
COMPENSATION BUT SHALL BE PAID THEIR REASONABLE AND
NECESSARY EXPENSES WHILE ENGAGED IN THE DISCHARGE OF
THEIR OFFICIAL DUTIES.
(C) NOTWITHSTANDING ANY OTHER PROVISION OF LAW TO THE
CONTRARY, THE BOARD OF TRUSTEES SHALL EXERCISE WITH
REFERENCE TO THE UNIVERSITY OF BALTIMORE, AND WITH
REFERENCE TO EVERY DEPARTMENT OF SAME, ALL THE POWERS,
RIGHTS, AND PRIVILEGES THAT GO WITH THE RESPONSIBILITY OF
MANAGEMENT, INCLUDING THE POWER TO CONDUCT OR
MAINTAIN SUCH DEPARTMENTS OR SCHOOLS IN SAID
UNIVERSITY AS THEY FROM TIME TO TIME MAY DEEM WISE; AND
SAID BOARD SHALL NOT BE SUPERSEDED IN AUTHORITY BY ANY
OTHER STATE BOARD, BUREAU, DEPARTMENT OR COMMISSION,
IN THE MANAGEMENT OF THE UNIVERSITY'S AFFAIRS, WITH THE
FOLLOWING EXCEPTIONS:
(1) TUITION FEES SHALL NOT EXCEED THE AVERAGE OF
THOSE CHARGED BY OTHER MARYLAND STATE INSTITUTIONS OF
HIGHER EDUCATION.
(2) ENROLLMENT OF NON-RESIDENT STUDENTS SHALL BE
LIMITED TO TEN PERCENT OF THE TOTAL FULL-TIME STUDENT
BODY.
(3) IN ORDER TO ENCOURAGE AND FACILITATE
FUND-RAISING PROGRAMS AND CONTRIBUTIONS FROM PRIVATE
SOURCES FOR THE USE AND BENEFIT OF THE UNIVERSITY OF
BALTIMORE, THE BOARD OF TRUSTEES IS HEREBY EMPOWERED
TO RECEIVE ANY GIFT, DONATION OR GRANT MADE BY ANY
INDIVIDUAL, ASSOCIATION, FOUNDATION, SOCIETY OR
CORPORATION OR FROM THE UNITED STATES GOVERNMENT, OR
ANY AUTHORIZED BRANCH, BOARD, COMMISSION, BUREAU,
AGENCY, DIVISION, SUBDIVISION OR DEPARTMENT THEREOF. ANY
SUCH FUNDS ACCEPTED BY THE BOARD OF TRUSTEES SHALL BE
DEPOSITED IN A NONBUDGETED ACCOUNT UNDER THE STATE
TREASURY DEPARTMENT. THOSE FUNDS MAY BE INVESTED AS
DESIRED BY THE BOARD OF TRUSTEES WITHIN THE LIMITS
PERMITTED BY STATE LAW.
