1420                                      LAWS OF MARYLAND                                Ch. 678

employees, and every person employed under contract by a SCHOOL OR school
district AND ANY PERSON OWNING OR OPERATING A SCHOOL
VEHICLE shall be subject to the regulations.

(b) Violations by school officers, employees and operators of school [buses]
VEHICLES. - Any officer or employee of any school or school district who
violates any of the regulations or fails to include obligation to comply with the
regulations in any contract executed by him on behalf of a school or school district
shall be guilty of misconduct and subject to removal from office or employment.
Any person OWNING OR operating a school [bus] VEHICLE [under contract
with a school or school district] who fails to comply with the regulations shall be
guilty of [breach of contract and the contract shall be cancelled after notice of
hearing by the responsible officers of the school or school district] A
MISDEMEANOR AND THE VEHICLE OR VEHICLES INVOLVED SHALL
BE SUBJECT TO SUSPENSION OR REVOCATION OF REGISTRATION
PRIVILEGES.

3-401.1. REGISTRATION OF SCHOOL BUS OR SCHOOL VEHICLE.

(A)  A TYPE I SCHOOL VEHICLE (SCHOOL BUS), WHEN OPERATING
FOR THE PURPOSE OF TRANSPORTING CHILDREN, STUDENTS OR
TEACHERS FOR EDUCATIONAL PURPOSES OR IN CONNECTION
WITH A SCHOOL ACTIVITY SHALL DISPLAY VALID DISTINCTIVE
"SCHOOL BUS" REGISTRATION PLATES ISSUED BY THE
ADMINISTRATION UPON PAYMENT OF THE PRESCRIBED FEE AND
SHALL COMPLY WITH ALL THE REQUIREMENTS CONTAINED IN
THIS ARTICLE AND IN THE ADMINISTRATION REGULATIONS
PERTAINING TO A TYPE I SCHOOL VEHICLE. WHEN OPERATING
FOR ANY PURPOSE OTHER THAN TRANSPORTING CHILDREN,
STUDENTS OR TEACHERS FOR EDUCATIONAL PURPOSES OR IN
CONNECTION WITH A SCHOOL ACTIVITY, A TYPE I SCHOOL
VEHICLE (SCHOOL BUS) SHALL DISPLAY VALID DISTINCTIVE
"SCHOOL CHARTER" REGISTRATION PLATES ISSUED BY THE
ADMINISTRATION UPON PAYMENT OF THE PRESCRIBED FEE.
"SCHOOL CHARTER" PLATES SHALL BE ISSUED IN PLACE OF AND
NOT IN ADDITION TO "SCHOOL BUS" PLATES AND ONLY TO
VEHICLES COMPLYING WITH ALL THE REQUIREMENTS OF THIS
ARTICLE AND ADMINISTRATION REGULATIONS PERTAINING TO A
TYPE I SCHOOL VEHICLE. THE "SCHOOL CHARTER" REGISTRATION
FEE SHALL INCLUDE THE "SCHOOL BUS" REGISTRATION FEE.

(B)     A TYPE II SCHOOL VEHICLE SHALL DISPLAY VALID
DISTINCTIVE REGISTRATION PLATES ISSUED BY THE
ADMINISTRATION UPON PAYMENT OF THE PRESCRIBED FEE AND
SHALL COMPLY WITH ALL THE REQUIREMENTS CONTAINED IN
THIS ARTICLE AND ADMINISTRATION REGULATIONS PERTAINING
TO A TYPE II SCHOOL VEHICLE.

TYPE I AND TYPE II SCHOOL VEHICLES SHALL BE PAINTED
YELLOW,         IN ACCORDANCE WITH ADMINISTRATION

REGULATIONS, USING THE COLOR KNOWN AS NATIONAL SCHOOL
BUS YELLOW, AS SPECIFIED IN FEDERAL STANDARDS. UNLESS
OTHERWISE PERMITTED OR AUTHORIZED BY THE PROVISIONS OF
THIS ARTICLE OR BY ADMINISTRATION REGULATION, NO OTHER
VEHICLE DESIGNED FOR CARRYING PASSENGERS SHALL BE
PAINTED NATIONAL SCHOOL BUS YELLOW OR A CLOSELY
