It shall be the duty of the State Horticulturist to carry out the work
of the horticultural investigation and experimentation, under the di-
rection of the Maryland Experiment Station.]
74. Airplane dissemination of insecticides, fungicides and bacteri-
cides.
(a) It shall be the duty of the [State Board] Secretary of Ag-
riculture[, through the State Entomologist or its duly authorized
officer or agent,] to determine whether there exist infestations or
infections which may be controlled in their spread or retarded by air-
plane dissemination of insecticides, fungicides and bactericides, and
whether there exist animal or human diseases with a known or sus-
pected [anthorpod] arthropod vector which may be controlled or
their spread retarded by airplane dissemination of insecticides,
fungicides and bactericides; and upon such a determination the
[State Board] Secretary of Agriculture is authorized and empowered
to employ such means of dissemination, the provisions of [Section 9 of
this Article 1A of the Annotated Code of Maryland (1939 Edition)
or on] any other existing provision of law to the contrary notwith-
standing.
(b) In order to accomplish the purposes of this section the
[State Board] Secretary of Agriculture[, through the State En-
tomologist or its duly authorized officer or agent,] is authorized and
empowered to expend such funds as may from time to time be appro-
priated in the State budget or otherwise for use in controlling in-
cipient, emergency or long-standing insect, fungus or disease out-
breaks which in the judgment of the [State Board of Agriculture]
Secretary and [its] cooperating agencies require drastic treatment
with respect to their immediate elimination as a menace to the eco-
nomic welfare and health of the people of the State.
(c) The [State Board] Secretary of Agriculture[, through the
State Entomologist or its duly authorized officer or agent,] is
further authorized and empowered to receive from any individual,
corporation, municipality or county funds for the purposes con-
templated in this section and to expend the same for the purposes
authorized therein HEREIN; to employ personnel and to execute such
work as may be undertaken pursuant to this section by contract or
free account as it may deem to be in the best interest of the State.
(d) The [State Board] Secretary of Agriculture[, through the
State Entomologist, or its duly authorized officer or agent,] is further
authorized and empowered to cooperate with other states and with
other state or federal agencies in the determination of the necessity
for and in the employment of airplane dissemination of insecticides,
fungicides and bactericides, and in the case of human diseases spe-
cifically the [State Board] Secretary of Agriculture is directed to co-
operate with the State Department of Health and Mental Hygiene.
75. Quarantine of infested or infected areas.
(a) In order to control, retard or eradicate any dangerously in-
jurious insects, other animal pests or plant diseases, the [officers of
the State Horticultural Department, acting through the State Board]
Secretary of Agriculture, may establish quarantines and/or rescind
quarantines against the introduction into the State of any plant ma-
