Sec. 2. And be it further enacted, That this Act is hereby declared
to be an emergency measure and necessary for the immediate preser-
vation of the public health and safety, and having been passed by a
yea and nay vote supported by three-fifths of the members elected
to each of the two houses of the General Assembly of Maryland, the
same shall take effect from the date of the passage.

AN ACT to repeal and re-enact, with amendments, Section 40 (i)
of Article 10 of the Annotated Code of Maryland (1968 Replace-
ment Volume and 1971 Supplement), title "Attorneys at Law and
Attorneys in Fact," subtitle "State's Attorney," to provide for
the appointment of a deputy and an assistant State's Attorney
in Charles County, the method of appointment, their salaries and
duties, and to provide for secretarial help for the State's Attorney's
office and generally relating thereto.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 40(i) of Article 10 of the Annotated Code of Maryland,
(1968 Replacement Volume and 1971 Supplement), title "Attorneys
at Law and Attorneys in Fact," subtitle "State's Attorney," be and it
is hereby repealed and re-enacted, with amendments, to read as fol-
lows:
[In Charles County, (1) the State's Attorney's salary is twelve
thousand dollars ($12,000). (2) The State's Attorney may appoint an
assistant State's attorney and a secretary. The assistant State's
attorney's salary is eight thousand five hundred dollars ($8,500).
The assistant State's attorney has the same legal powers as the
State's Attorney to represent the State before grand juries and in
the trial of criminal proceedings.]
In Charles County, the State's Attorney's salary is twelve thousand
dollars ($12,000) per annum. He shall appoint a deputy State's
Attorney whose salary shall be at such compensation, not exceeding
fifteen thousand dollars ($15,000) per annum, as the State's Attorney
may deem proper, to be paid by the County Commissioners. In addi-
tion to the deputy State's Attorney, the State's Attorney may appoint
one assistant State's Attorney whose salary shall be fixed by the
State's Attorney, with the approval of the County Commissioners,
at a sum not exceeding ten thousand dollars ($10,000) per annum.
The deputy State's Attorney and the assistant State's Attorney
shall serve at the pleasure of the State's Attorney and shall perform
such work as may be directed by the State's Attorney, or as au-
thorized by law, and may present cases to the grand juries, sign
indictments and criminal informations and perform such other acts
and duties in relation to the grand juries and in the operation of the
office as are necessary and proper.
