124.

Any person who shall enter upon the land or premises of any
other person, whether such person be the owner or lessee of said
land or premises and wilfully act in a disorderly manner by mak-
ing loud and unseemly noises, or by profanely cursing or swearing
of using obscene language or acting in any other disorderly manner
while thereon, shall upon conviction thereof be sentenced to pay a
fine of not less than one dollar and not more than twenty-five dol-
lars, and the costs of the prosecution, and the several justices of the
peace of this State shall have concurrent jurisdiction over such of-
fense with the circuit courts for their respective counties, and when
said fine and costs are not paid, the parties so convicted shall MAY
be committed to the county jail for a term not exceeding thirty days
or until discharged in due course of law PURSUANT TO THE PRO-
VISIONS OF ARTICLE 38, SECTION 4; provided, however, that
the provisions of this section shall only apply to Allegany County,
Caroline County, Cecil County, Charles County, Frederick County,
Harford County, Howard County, Montgomery County, Prince
George's County, St. Mary's County, Carroll County, Queen Anne's
County, Washington County, Worcester County, Talbot County,
Wicomico County, Dorchester County, [and] Kent County and Somer-
set County;
provided that in Worcester County this Section shall also
apply to beaches adjacent to residential riparian property and pro-
vided further that no bonfires shall be built nor allowed to burn on
any beach or other property in Worcester County between the hours
of 1:00 o'clock a.m. and 5:00 o'clock a.m.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1972.

CHAPTER 326
(House Bill 1092)

AN ACT to repeal and re-enact, with amendments, Section 3(a) of
Article 25 of the Annotated Code of Maryland (1966 Replacement
Volume and 1971 Supplement), title "County Commissioners," sub-
title "General Provisions," to remove Somerset County from the
list of excepted counties, and to grant to Somerset County certain
powers enumerated in that section.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 3(a) of Article 25 of the Annotated Code of Maryland
(1966 Replacement Volume and 1971 Supplement), title "County
Commissioners," subtitle "General Provisions," be and it is hereby
repealed and re-enacted, with amendments, to read as follows:

(a) The county commissioners of each county in this State, ex-
cept Worcester, (except as provided in subsection (1) hereof),
Prince George's, Washington (except as hereinbelow provided),
