(b)    Each application shall be on forms prescribed by the County
Road Engineer and accompanied by a fee of $2.00 for each opening.
In addition, when applicable, each application shall be accompanied
by an additional application fee of twenty cents (.20) for each addi-
tional square foot of surface opening in excess of twelve square feet.
All applicants shall furnish the County Road Engineer with a memo-
randum copy of an insurance policy in current force covering public
liability.

(c)    The County Road Engineer shall grant a permit to any appli-
cant to open the surface of any street, road, or public thorough-
fare, if the County Road Engineer determines:

(1)    That the opening is for the purpose of installing or repair-
ing water pipes, sewer lines, gas lines, telephone cables, or electrical
cables; and

(2)    That the applicant has sufficient insurance to cover any lia-
bility to the public which may arise out of the openings; and

(3)    The opening will not be unduly hazardous to the traveling
public.

(d)    The County Road Engineer may waive the requirement for a
permit under this subtitle, if the person who desires to open the sur-
face of a street or road has obtained a permit from the City Engineer
for the City of Cambridge.

339B.

(a)    All openings which are made in streets shall be backfilled by
compacting the bank run gravel in layers not over 8" in depth with
a hand tamper, a mechanical vibrating tamper, or a pneumatic tamper
and shall comply with applicable rules and regulations of the County
Road Engineer. After placing the fill, the person opening the surface
of the street or road shall pave the opening with an approved cold
mix patch material two inches in thickness. All of the aforesaid work
shall be completed within four days from the time the digging of the
hole was first begun, unless the person opening the surface of the
street or road obtains a new permit from the County Road Engineer.
For a period of 30 days after the completion of work, the person
opening the surface of the street or road shall be required to make
such repatches as may be necessary to keep the street or road in a
good condition.

(b)    In addition to the above, permanent repairs shall be made
by the person who has opened the street or road if the surface of the
street or road opened consists of concrete, bituminous concrete or
brick with a concrete base; and these repairs shall be made within
60 days after the street opening, unless for good cause the County
Road Engineer extends the time. The repairs shall be made in ac-
cordance with the rules and regulations of the County Road Engineer
and all brick streets shall be repaired with concrete brought flush
with the surrounding brick surface. On any street, which the person
who has opened the street or road, is required to make permanent
repairs as set forth in this subsection, he shall be responsible for
keeping the temporary repairs set forth in subsection (a) above in
good condition until such time as the permanent repairs are
completed.
