The County Road Engineer may make all rules and regulations
necessary to assure that openings of surfaces of street and roads will
not constitute a hazard to the traveling public, and that all repairs of
openings of road and street surfaces will restore the street to their
original condition.
339D.
Any person who opens the surface of any street or road without
first obtaining a permit, or who wilfully and knowingly violates any
of the provisions of Sections 339A or 339B of this subtitle shall be
guilty of a misdemeanor and, upon conviction, be subject to a fine of
not more than $1,000.00.
Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1972.

CHAPTER 311
(House Bill 878)
AN ACT to repeal and re-enact, with amendments, Section 15(b) of
Article 88B of the Annotated Code of Maryland (1969 Replace-
ment Volume), title "State Police," subtitle "Management of De-
partment," to give the Superintendent of State Police the power
to give permission for the use of marked state police vehicles by
off duty state police officers as a deterrent to crime under certain
conditions.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 15(b) of Article 88B of the Annotated Code of Mary-
land (1969 Replacement Volume) title "State Police," subtitle "Man-
agement of Department," be and it is hereby repealed and re-enacted,
with amendments, and to read as follows:
15.
(b) Enumeration of special powers.—In supervising and direct-
ing the affairs of the Department and in exercising the powers re-
ferred to in the preceding subsection, the authority of the Superin-
tendent shall include, but shall not be limited to, the powers:
(1) To determine and establish the form of organization of the
Department;
(2) To create subordinate organizational subdivisions within the
Department; to determine and define the functions, duties, and re-
sponsibilities of each such organizational subdivision; and, from
time to time, to reclassify and redefine the functions, duties, and
responsibilities of any departmental subdivision, whether created by
the Superintendent or by law;
