tion," subtitle "Maryland Council for Higher Education," amend-
ing the duties and functions of the Maryland Council for Higher
Education, providing for an executive director of the Council, and
correcting certain errors therein RENUMBERING CERTAIN
PARAGRAPHS AND CORRECTING CERTAIN ERRORS
THEREIN.

Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 28(a-l), 29(b), 30(a), 31 and 32 of Article 77A of the
Annotated Code of Maryland (1969 Replacement Volume), title
"Higher Education," subtitle "Maryland Council for Higher Educa-
tion," be and they are hereby repealed and re-enacted, with amend-
ments, all to read as follows:

28.

(a-1) The four members added to the Council in 1968 shall be
appointed by the Governor from persons having qualifications similar
to those in subsection (a), except that one shall be a [representa-
tion] representative of the University of Maryland, nominated by
the Board of Regents of the University of Maryland, one shall be a
[representation] representative of the State Colleges nominated by
the Board of Trustees of the State Colleges, one shall be a member of
the State Board responsible for Community Colleges, and one shall be
a representative of the several private institutions of higher educa-
tion in this State. Of the first four persons appointed under this
subsection, one shall be appointed for a term of three years, one for a
term of four years, one for a term of five years, and one for a term
of six years.

29.

(b) The Council shall appoint [a] an executive director [of
research] who shall not be subject to the provisions of Article 64A
of this Code, title "Merit System" and who shall perform such
functions as the Council may prescribe; and the Council may
employ such other assistants as are in the budget provided. The
executive director [of research] and all professional and clerical
employees of the Council shall be eligible for membership in, and
shall become members of, the Teachers' Retirement System of the
State of Maryland. The salaries of all employees and the administra-
tive expenses of the Council shall be as provided in the annual budget.

30.

(a) It shall be the duty of the Council TO COORDINATE THE
GROWTH AND OVERALL DEVELOPMENT OF HIGHER EDU-
CATION IN THE STATE, to coordinate the growth and over
-
all development of higher education in the State, to conduct
studies concerning the various aspects of public higher education
in the State, to report the result of its researches, and to make
recommendations to the governing boards of the public institutions
of higher education and to appropriate State officials with respect to
the matters [its] it has considered. The functions of the Council
shall include the following:
