additional categories of special leave which may be authorized by
the Commissioner of Correction for an inmate to leave an institu-
tion to participate in certain programs or activities.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 700D of Article 27 of the Annotated Code of Maryland,
(1971 Replacement Volume), title "Crimes and Punishments," sub-
title "III Places of Reformation and Punishment," subheading "Pris-
oners," be and it is hereby repealed and re-enacted, with amend-
ments, to read as follows:
700D.
Upon the recommendation of treatment staff, with the approval of
the warden or superintendent of any State penal or reformatory
institution under his jurisdiction, the Commissioner of Correction
may authorize special leave to an inmate to leave an institution for
participation in special community or other meritorious programs or
activities deemed beneficial to the inmate, and not detrimental to the
public, by both the warden or superintendent and the Commissioner
of Correction and which in their judgment would contribute to the
rehabilitation process of the respective inmate. To be considered for
this special leave the inmate shall be eligible solely upon the con-
currence of the warden or superintendent and the Commissioner of
Correction that positive attitudinal and growth patterns are being
established. All special leaves must be issued in writing and must be
signed by both the warden or superintendent and by the Commis-
sioner of Correction, and this authority may not be delegated. All
such orders must be kept on file in the Department. Special leave may
only be for the purpose of:
(a) Attending educational programs.
(b) Improving job skills.
(c) Attending trade licensing examinations.
(d) Being interviewed for employment.
(e) Participating as a volunteer for a governmental agency in an
activity serving the general public.
(f) Participating in athletic competition.
(g) Participating in civic activities beneficial to the inmate and/
or the community.
Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1972.
