recovered, the remaining one half shall be paid to the Director of the
Game and Inland Fish Commission or State Comptroller, to be placed
to the credit of the Conservation Fund to be used as provided by law.]
All fines and costs shall be paid in accordance with Article 38,
Section 4.

§ 356. [Jurisdiction of justices of the peace and] Prosecution by
State's attorneys.

[Justices of the peace for this State in the county wherein the
offense shall have been committed shall have jurisdiction to hear
and determine all prosecutions for the purpose of enforcing fines and
penalties, collectible under the provisions of this subtitle, not exceed-
ing the amount of $100.00 and of holding the offender, under proper
bail if necessary, for hearing before the circuit court, committing
them to the county jail until such hearing if the required bail is not
furnished.] It shall be the duty of the State's attorneys of the several
counties to prosecute all violators of § 352 of this subtitle.

§ 357. Forest or Park Reserve Fund.

All moneys received as penalties for violations of the provisions of
this subtitle shall be collected pursuant to the provisions of Article
26
§ 155; however, if the fine is imposed by the circuit court for any
county or the Criminal Court of Baltimore, as the case may be, the
fine when collected,
less the cost of collection and not otherwise pro-
vided for, together with any moneys obtained from the State forest
reserve, State parks, scenic preserves, parkways, historic monu-
ments and recreation areas, shall be paid into a special fund in the
State treasury known as the Forest or Park Reserve Fund; out of
said funds there shall be paid each year to the county commissioners
of each county in which shall be located any part of the State forests
or parks reserves fifteen percent of the revenue derived from such
part of the State reserves as is located in that county. On July 1,
1969 and on July 1 of each year thereafter the balance of moneys
in this fund in excess of one hundred and seventy-five thousand dol-
lars ($175,000.00) shall be paid over to the general funds of the
State.

§ 375D. Penalty for violation.

Any violation of §§ 375A to 375C, inclusive, of this subtitle shall
constitute a misdemeanor and any person convicted thereof before a
[trial magistrate or another] court of proper jurisdiction shall be
punished by a fine of not less than ten dollars nor more than five
hundred dollars or by imprisonment of not less than thirty or more
than ninety days, or both.

§ 399. Penalty.

A person who violates the provisions of this subheading or of
rules or regulations made by the Commission of Forests and Parks, or
by the district forestry board, with the approval of the Commis-
sion of Forests and Parks under the authority of this subheading, shall
be deemed to have committed a misdemeanor and shall be fined not
less than $10 nor more than $500, or imprisoned for not more than
six months. The fines [collected hereunder] shall be collected pursuant
to the provisions of Article 26
