Article I, titled "Sewerage and Drainage Generally," as obsolete
and unnecessary duplications of existing County authority to
provide sewerage and drainage facilities and services.

AN ACT to amend Chapter 22, titled "Sewers, Sewage Disposal and
Drainage," of the Montgomery County Code 1965, by repealing
and re-enacting, with amendments, Section 22-37, titled "Au-
thority of Council to propose districts by resolution," Section
22-38, titled "Resolution proposing district to specify boundaries,
scope of work and costs," Section 22-39, titled "Financing
generally," Section 22-40, titled "Contracts, cost sharing, etc.,"
Section 22-41, titled "Preliminary planning," and Section 22-42,
titled "Hearing prior to adoption of resolution," and by repealing
in its entirety, Section 22-44, titled "Creation by public local
law," to provide for the creation of storm drainage districts by
the County Council by law; to authorize the County Executive
to administer such districts and promulgate reasonable regula-
tions for the implementation and administration of such dis-
tricts, to provide that laws creating such districts specify bound-
aries; scope of work, costs and manner of financing; to provide
for preliminary planning by the County Executive and public
hearings by the Council prior to the enactment of legislation
creating storm drainage districts; to authorize the County Exec-
utive to negotiate appropriate contracts with any governmental
body or agency or any private person concerning matters neces-
sary, advisable or expedient for the proper construction, main-
tenance and operation of any drainage system within a district
created hereunder; to delete repetitive and obsolete provisions
concerning creation of a district and conformity to the prior
Charter.
