CHAPTER 7
(BILL NO. 29-70)

AN ACT to amend Chapter 108, title "Vehicles, Traffic and Parking,"
by adding a new Section 108-36A, title "Parking privileges for
disabled persons," Montgomery County Code 1965, as amended,
providing that certain physically disabled persons may be al-
lowed, upon application and payment of a fee, to a permit which
would allow the permit holder to park without liability for park-
ing violations, except in certain specified places within the
county.

Be It Enacted by the County Council for Montgomery County,
Maryland,
that—

Sec. 1. Chapter 108, title "Vehicles, Traffic and Parking,"
Montgomery County Code 1965, as amended, is hereby amended to
add a new Section 108-36A as follows:

108-36A. Parking privileges for disabled persons.

(a)    Any person who shall submit proof satisfactory to the
Director of the Department of Inspection and Licenses that he, or a
person he regularly transports or chauffeurs, has lost both of his
lower extremities, or who has permanently lost the normal or full use
thereof, or who is so severely disabled as to be unable to move without
the aid of crutches or a wheelchair, shall be entitled, upon payment of
the fee therefor, to receive a permit for special parking privileges for
disabled persons. Each such permit shall be renewable every two
years, and the fee for said permit shall be determined by the County
Executive, but shall not exceed the pro rata cost of administering
the program.

(b)    The County Executive shall, from time to time, establish
the limitations on special parking privileges granted hereunder.
Each permittee at the time a permit is granted, and at time of renewal,
shall be furnished a written notice of parking restrictions, including
a description of streets or roads, where the permit does apply. The
Executive shall send notice by ordinary mail to each permit holder of
any changes in the parking privileges should they occur prior to re-
newal of the respective permits.

(c)    The parking privileges granted herein shall entitle a permit
holder to courtesy in the parking of his automobile, which shall re-
lieve him from liability for non-moving parking-type violations, in-
cluding meter fees, with respect to parking, other than a violation
of the restrictions on the permit established by notice of the County
Executive. Privileges shall only be granted when the permit holder
displays at the designated place on his automobile the decal issued by
the Department of Inspection and Licenses which signifies any auto-
mobile regularly used by a disabled driver.
