108-40. Repairing or leaving vehicles on streets for same.
It shall be unlawful for any person or business entity to perform
service or repairs on a vehicle parked on a public street or public
parking facility within the County, except for emergency service or
repairs, or to store or park on any public street any motor vehicle left
in the custody of the management of the garage, repair shop, or serv-
ice facility except for the time necessary to permit the removal of
another car from the garage, repair shop or service facility.
108-41. Penalty for violations of Article.
Any person who shall violate any of the provisions of this Article
shall, upon conviction thereof, be fined not more than fifty dollars or
imprisoned for not more than thirty days for each violation.
108-42. Presumption, issuance of warrants; towage.
(a) In any prosecution charging a violation of any provision of
the preceding Sections of this Chapter the provisions of Section
108-23A of this Code shall apply.
(b) In the event of a violation of any of the provisions of the
preceding Sections of this Chapter the provisions of Sections 108-23B
and 108-23C of this Code shall apply.
ARTICLE VI. IMPROPER USE OF VEHICLE.
108-43. Driving over curbs, sidewalks or drainage structures.
It shall be unlawful for any person to drive, or cause to be
driven, any vehicle including a motor vehicle on or over any curb,
sidewalk or drainage structure, except over driveways constructed
for such purpose; provided, however, that this Section shall not apply
in emergencies where suitable provision is made, by the laying of
planking or otherwise, for the bridging of such curb, sidewalk or
drainage structure in such a way that no damage will be done thereto.
Any person violating the provisions of this Section shall be deemed
guilty of a misdemeanor, and upon conviction thereof by any court
of competent jurisdiction shall be punished by a fine of not more
than fifty dollars or imprisonment of not more than thirty days.
Sec. 4. For the purposes of this Chapter all references to County
Executive shall mean County Manager until the election and qualifi-
cation of a County Executive.
Sec. 5. This Act shall take effect on the 76th day following its
enactment.
Sec. 6. Chapter 115, Montgomery County Code 1965 is hereby
repealed.
SEC. 7. Chapter 16, Section 16-4, Montgomery County Code
1965 is hereby repealed.
