(3)    Hearing on objections. If any objection to the granting
of the franchise is made by any person interested therein, either as a
taxpayer or as one whose property rights are involved, and filed in
writing with the County Executive within ten days after the last
notice appears a hearing shall be held on such objections by the
County Executive or his designee.

(4)    The County Executive shall in each case, and subse-
quent to any hearings which may be required by this Section, for-
ward to the Council his written recommendations setting forth a
description of the application, findings as to value, and a resume of
any objections which may have been raised as well as any other
relevant and pertinent matters.

Sec. 10. Section 24-17, Chapter 24, title "Streets and Roads,"
of the Montgomery County Code 1965, is hereby repealed and re-
enacted, with amendments, to read as follows:

24-17. Same—Conditions of grant; time limit, etc.

If no valid objection is made to the granting of such franchise and
it appears to the Council that the granting of the same is expedient and
proper, the Council shall have authority to grant such franchise for
such money compensation as it shall after consideration of the recom-
mendations of the County Executive, determine to be proper and as
may be prescribed by such Council, for a period not longer than
twenty-five years, but such grant may at the option of the Council pro-
vide for giving the grantee the right, and fair revaluation, including in
such revaluation the value, if any, derived from the franchise or right
to renewals, not exceeding in the aggregate twenty-five years. Every
grant of any such franchise or right shall make provisions, by way of
forfeiture of the grant, for the purpose of compelling compliance with
the terms thereof and to secure efficiency of public service at reason-
able rates and the maintenance of the property in good condition
throughout the full term of the grant. The grant shall also specify
the mode of determining the valuation and revaluation which may be
provided for therein, and the time limitation in which there shall
be an exercise of the rights given, and in default thereof for a lapse of
the grant.

SEC. 11. Section 24-21, Chapter 24, title "Streets and Roads,"
of the Montgomery County Code 1965, as amended, is hereby repealed
and re-enacted, with amendments, to read as follows:

24-21. Acceptance of streets, etc.

The County Executive may prescribe by written order, adopted
pursuant to the procedure prescribed by law, the terms and conditions
upon which any street, alley, road or thoroughfare which has been
acquired by the County or dedicated to public use may be accepted,
and he may authorize the acceptance of all streets, alleys, roads or
