2710                            County Local Laws

thoroughfares upon such terms and conditions, provided such streets,
alleys, roads or thoroughfares conform to the standards and specifi-
cations of the Montgomery County Road Construction Code in force
at the time of acceptance. The County Council may provide by law
for the acceptance of streets, alleys, roads or thoroughfares by the
County Executive which do not conform to the standards and speci-
fications of such County Road Construction Code provided such law
shall establish standards and conditions for acceptance to protect the
public interest. Upon the acceptance of any street, alley, road or
thoroughfare, it shall become a part of the county road system and
shall thereafter be maintained by the County at its expense.

Sec. 12. Subsections (b) and (d) of Section 24-22, Chapter 24,
title "Streets and Roads," of the Montgomery County Code 1965, is
hereby repealed and re-enacted, with amendments, to read as follows:

24-22. Removal of trees, bushes and other obstructions to vision of
persons operating vehicles on public highways.

(b) Petition for hearings; hearings generally, etc. Any person
who considers himself aggrieved by any order issued pursuant to the
authority of this Section may, within ten days of the receipt of such
order, petition in writing for a hearing thereon before the Board of
Appeals. Within thirty days from the receipt of such petition, the
Board shall hold such a hearing after which it may either affirm,
modify or rescind the order. No official of the County government
shall remove any obstruction or enforce any order issued hereunder
until after such hearing has been held or until the time to petition
for such hearing has expired without such a petition having been

filed.

(d) Service of orders and notices. All orders and notices issued
pursuant to the authority of this Section shall be served on the
person to whom they are directed either by registered or certified
mail or by personal delivery to such person. If such person is not
known to reside and cannot be found in the County, such service shall
be made by publication of such order or notice once in a newspaper of
general circulation in the County and by posting the same on the
premises in a conspicuous manner. Service by publication and post-
ing shall be deemed to be made on the day of publication or posting.

Sec. 13. Subsections (a) and (b) (3) of Section 24-29A, Chap-
ter 24, title "Streets and Roads," of the Montgomery County Code
1965, as amended, is hereby repealed and re-enacted, with amend-
ments, to read as follows:

24-29A. Licensing and regulating hoisting.

(a) Whenever, in the judgment of the County Executive, it is
necessary for the safety and control of vehicular or pedestrian traffic,
