Upon receipt of an application for a franchise, the Council Secretary
shall give written notice thereof at least once a week for three successive
weeks in a newspaper of general circulation in Howard County. A public
hearing will be held by the County Council within eight weeks after the
receipt of an application. In the event that there are two or more appli-
cants for a franchise to operate a Community Antenna Television System
in the same initial service area, the County Council will hold separate
hearings for each applicant.

The Council shall consider, among other factors, in awarding and/
or renewal of a franchise:

(a)  The lowest proposed cost.

(b)  The applicant's proposed plans for CATV use or uses.

(c)   The suitability of the applicant to hold the franchise.

The franchise to be granted shall be subject to and shall incorporate
all of the provisions of this Act.

14.731. Severability.

If any clause, sentence, part or parts of this subtitle, or any section
thereof shall be held unconstitutional or invalid such unconstitutionally
or invalidity shall not affect the validity of the remaining parts of this
subtitle or of any section thereof. The County Council hereby declares
that it would have passed the remaining parts of this subtitle or any
section thereof if it had known such clause, sentence, part or parts of
any section thereof should be declared invalid or unconstitutional.

Section 2. And be it further enacted by the County Council of Howard
County, Maryland,
That this Act shall take effect sixty (60) days after
its enactment.

This Bill having been approved by the Executive and returned to the
Council stands enacted on October 12, 1971.

Council Bill No. 36

An Act adding Section 19.301 to title 19 of the Howard County
Code title "Recreation and Parks", subtitle "Park Land and Watershed
Facilities Fund", providing that the County Executive may negotiate
and add to the purchase price, of lands acquired under this Act, a sum
of money sufficient for the relocation of persons displaced by the ac-
quisition under the provisions set forth in Public Law 91-646.

Section 1. Be it enacted by the County Council of Howard County,
Maryland,
that Section 19.301 be and the same is hereby added to Title 19
of the Howard County Code, title "Recreation and Parks", subtitle "Park
Land and Watershed Facilities Fund", to read as follows:

19.301

With respect to any land acquired under this Act, a portion of the ac-
quisition price of which is contributed by the United States of America,
the County Executive may negotiate and add to the purchase price a sum
of money sufficient for the relocation of persons displaced by such acquisi-
tion in accordance with the terms and provisions as set forth in Public
