2686                               County Local Laws

14.730. Procedure.

(a)  Applicants for a franchise pursuant to this Act shall submit an
application therefore to the County Council. Every application for a fran-
chise or renewal shall be signed by the applicant, if an individual, or by
all parties, if a partnership, or by the applicant's chief executive officer;
if the applicant is a corporation or other legal entity. Every applicant shall
submit with the application a non-refundable processing fee in the amount
of One Thousand ($1,000.00) Dollars.

(b)  The franchise application shall contain the following informa-
tion together with such additional information as may be required by the
Council:

1.    The names, home addresses, principal occupations, and business
addresses of all persons having an ownership interest in the applicant;

2.   The name in which the applicant will conduct his business;

3.   The address of the applicant's principal office;

4.   The names, home addresses, principal occupations, and business
addresses of all persons who are officers or directors and all persons who
are to have a five percent or more interest in the applicant and any other
persons which the Council may designate;

5.   The names of all parent or subsidiary companies of the applicant,
together with the names, home addresses, principal occupations and busi-
ness address of all persons who are officers or directors of such parent or
subsidiary companies;

6.   A description of the prior experience, if any, of the applicant's
officers and directors in the operation of CATV Systems including any
disciplinary action of any nature imposed by a court or governmental
agency related to CATV operations;

7.   A balance sheet of the applicant, dated no earlier than thirty
days preceding the date of the application, certified by a certified public
accountant, if the applicant is a partnership, copies of the certified balance
sheets of all general partners shall be submitted;

8.   The applicant must be a resident of, Howard County, or if a cor-
poration, must be qualified to do business in the State of Maryland, the
name and address of a resident agent or any attorney in-fact upon whom
service of process may be made in Howard County must be supplied ;

9.   A statement of all rates proposed to be charged for all services to
be offered by the applicant.

10.   A detailed description of the applicant's proposed plans for CATV
use or uses;

11.   A description of the initial service area proposed to be served
by the applicant; together with a detailed schedule for extending service
to all parts of the initial service area, and a schedule setting forth the pro-
posed minimum franchise fees for each year during which the franchise
is to be effective;

12.   A statement of the number of homes to be served outside of the
initial service area annually.

(c)   If any information furnished in an application becomes inaccu-
rate, the applicant shall furnish the Council with the corrected informa-
tion within ten days after such information becomes inaccurate.
