BILL NO. 70

AN ACT to enlarge the powers of the County Dog Wardens, to trans-
fer certain duties of the Dog License Commission to said Dog
Wardens, and to reflect the change over from trial magistrates to
district courts, by repealing and re-enacting with amendments
Sections 3-8, 3-15 (a), 3-17 (b) (c) and (d), 3-19 (a), 3-20, 3-21
(b), 3-24, 3-25, 3-30 (a) and (c) of the Baltimore County Code,
1968, title "Animals" Article I. Dogs, by adding new Subsection
(e) to Section 3-17 of said Code, Title and Article, and by repeal-
ing Section 3-25 of said Code, Title and Article and enacting a new
Section 3-25 in lieu thereof.

Section 1. Be it enacted by the County Council of Baltimore
County, Maryland,
That Section 3-8 of the Baltimore County Code,
1968, Title "Animals," Article I. Dogs, be and it is hereby repealed
and re-enacted with amendments to read as follows:

Section 3-8. Same—Executive Secretary and other personnel;
powers of dog wardens.

The county administrative officer, subject to the approval of the
county executive, shall appoint an executive secretary at a rate of
compensation to be fixed by the county executive, and such other em-
ployees as the dog license commission may deem necessary, the com-
pensation of such employees to be determined by the county execu-
tive. The executive secretary, subject to the approval of the county
executive and the dog license commission, shall appoint dog wardens
as deemed appropriate for the execution and enforcement of this arti-
cle. Such dog wardens, when appointed and after taking an oath of of-
fice before the clerk of the circuit court for the county, shall have the
following duties, responsibilities and authority: They shall possess
and exercise all the authority and powers held or exercised by consta-
bles at common law and under the statutes of this state and also all
authority and power conferred by law upon policemen of the county
as far as issuing summonses and warrants for violating any provi-
sions of this law, and such other duties as set forth hereinafter in this
law.

Section 2. Be it further enacted, that Subsection (a) of said
Section 3 -15 of the Baltimore County Code, 1968, title "Animals," Ar-
ticle I. Dogs, be and it is hereby repealed and re-enacted with amend-
ments, to read as follows:

Section 3-15. Penalties for violating Sections 3-10 and 3-11 of this
Code.

(a) Any person refusing to comply with any of the provisions
of sections 3-10 and 3-11 of this Code shall be guilty of a misde-
meanor, and upon conviction thereof before any [trial magistrate]
district court of the county or in the circuit court for the county,
shall be subjected to a minimum fine of not less than five dollars, and
not more than twenty-five dollars, or shall be imprisoned in the county
