jail for not more than thirty days, or shall be both fined and impris-
oned, in the discretion of the [trial magistrate] district court or cir-
cuit court. It shall be the duty of the state's attorney, the sheriff, the
county police and the dog wardens of the county to prosecute all per-
sons found violating the law by failing or refusing to comply with its
provisions.

Section 3. Be it further enacted, that Subsections (b) (c) and
(d) of Section 3-17 of said Code, title and article, be and they are
hereby repealed and re-enacted with amendments to read as follows:

Section 3-17. Owner's responsibility for keeping dogs under con-
trol.

(b)    The [dog license commission] dog wardens will investi-
gate any reports of violations and shall seize or cause to be seized any
dog seen at large. If, upon investigation of any report of violations,
the dog is not in sight and the owner of the dog is known by the
[complainant] dog warden, [the dog license commission will make
available] he shall issue an "Order of [Complaint] Compliance"
[which may be completed by the complainant and which should also
bear the signatures of two other residents in the same area] to such
owner
attesting to the violation. When there is no previous seizing of
the dog or previous complaint against the owner, the dog, if seized,
shall be returned to the owner, and the [dog license commission]
dog warden may issue to the owner [a written warning] an order of
compliance.
A copy of any such warning shall be filed in the office of
the dog license commission. The [dog license commission] dog war-
den,
in the enforcement of the provisions of this section, shall use the
services and personnel of the Humane Society of Baltimore County.

(c)    Where there is a record of a previous seizing of a dog or
previous complaint against an owner, [upon seizing the dog or upon
receipt of a properly completed "Order of Complaint,"] the dog, if
seized, shall be returned to the owner, and the [dog license commis-
sion] dog warden may cause summons or a warrant to be issued to the
owner of such dog.

(d)    Any owner failing to comply with the provisions of this
section after a warning has been issued in accordance with the pro-
visions of subsection (b) hereof shall be guilty of a misdemeanor, and
upon conviction thereof [before any trial magistrate] in the district
court
of the county or in the circuit court for the county, shall be sub-
ject to a fine of not more than twenty-five dollars for each offense.

Section 4. Be it further enacted, that new subsection (e) is
hereby added to Section 3-17 of said Code, title and article, said new
subsection to read as follows:

(e)    The order of compliance provided for in subsection (b)
hereof shall be subject to review by the dog license commission upon
application in writing, by the owner within ten days from the date of
said Order. If no application for review is filed with the commission
within said period, the order shall become final.
