days of the expiration of the permit, he shall present a written
request for extension to the Department of Inspections and Permits,
setting forth the reasons therefor. Where, in the sole discretion of
the Department of Inspections and Permits, such an extension is
warranted, it may grant such additional time as may be necessary.

(b) If operations cease for a period of ninety (90) con-
secutive days, permanent erosion and sediment control measures
shall be employed as set forth in Article V of this Subtitle.

Section 12-2015. TIME LIMITATIONS—BORROW PIT, QUAR-
RIES, MATERIAL PROCESSING FACILITIES.

(a) Permits issued for sand, gravel, or clay pits, rock
quarries or any other mining or material processing operations
involving excavation and/or stockpiling of soil, rock, or other
materials shall lapse one (1) year after termination of continuous
operations and active removal of material. Said permits shall be
reviewed annually by the Department of Inspections and Permits
for compliance in accordance with the approved grading plan.

(b) If active, productive and continuous operations are not
conducted DISCONTINUED on the site within ninety (90) days SIX
(6) MONTHS of the issuance of said permit, the Department of
Inspections and Permits shall require the erosion and sediment con-
trol measures set forth in Article V of this Subtitle.

(C) IF THE WORK AUTHORIZED UNDER A GRADING
PERMIT DOES NOT COMMENCE WITHIN SIX (6) MONTHS
AFTER ITS ISSUANCE, SAID PERMIT SHALL BE DECLARED
VOID, AND ANY SECURITY SHALL BE RELEASED AND RE-
TURNED TO THE PERMITTEE AND/OR SURETY.

Section 12-2016. RESPONSIBILITY FOR DAMAGES.

Neither the issuance of a permit under the provisions of this
Subtitle nor the compliance with the provisions of this Subtitle
shall relieve any person from any responsibility for damage to
persons or property otherwise imposed by law, nor impose any
liability upon the County for any such damages.

Section 12-2017. REMOVAL OF DEBRIS.

No debris or other materials shall be deposited in floodplains,
watercourses, public streets, highways, sidewalks or other public
thoroughfares.

Section 12-2018. MAINTENANCE OF PROTECTIVE MEA-
SURES.

All graded surfaces, erosion control measures, vegetative covers
and/or other protective measures disturbed or destroyed during
the course of operations shall be promptly repaired, restored and
maintained in accordance with the approved plans and specifications
until permanent measures are accepted by the Department of
Inspections and Permits.
