LETTER OF GUARANTEE IN A FORM APPROVED BY THE
OFFICE OF LAW.

Section 12-2011. OTHER TYPES OF SECURITY.

(a)    In lieu of a performance collateral bond, the applicant may
file with the Department of Inspections and Permits a performance
bond, or deposit
cash DEPOSIT or certified check in an amount which
would
fee required fey a performance bond; EQUAL TO THAT
WHICH WOULD BE REQUIRED BY A PERFORMANCE BOND
provided that every such bond or deposit shall be subject to the condi-
tions of Section 12-2010 (2) 12-2010 (a) of this Subtitle.

(b)    Upon satisfactory completion of the work specified in the
grading permit, any unused portion of a cash deposit shall be refunded
to the applicant.

Section 12-2012. REFUSAL TO AUTHORIZE WORK.

If at any time the Department of Inspections and Permits deter-
mines that the work has not
been performed in accordance with the
approved plans and specifications (or with any other provisions of

this Subtitle), at the option of the County, the cash deposit may be

forteited, or (if a bond has been posted) the bond may be called.

The funds, as received, shall be used by the County for defraying the
cost of the restoration of the site in accordance with the provisions
of this Subtitle.

ARTICLE IV—TERMS, CONDITIONS AND
LIMITATIONS OF PERMIT

Section 12-2012. FLOOD PLAIN HAZARD.

If the land area for which the grading is proposed lies within the
fifty (50) year flood plain of any stream or watercourse, the Depart-
ment of Inspections and Permits shall deny a grading permit or
grading within said area in accordance with the provisions of Sub-
title I of this
Title 13 OF THIS CODE, SUBTITLE I, "SUB-
DIVISIONS", except where such grading is authorized by the State
Department of Water Resources.

Section 12-2013. CONDITIONS OF APPROVAL.

The Department of Inspections and Permits may impose
additional conditions as may be necessary to prevent the creation
of a nuisance or unreasonable hazard to persons or property in-
cluding, but not limited to, the following:

(1)    Improvement of any existing grading.

(2)    Designation of easements for drainage facilities and
maintenance of slopes or erosion control facilities.

(3)    Adequate control of dust by watering or other control
methods acceptable to the Department of Inspections and Permits.

Section 12-2014. TIME LIMITATIONS.

(a) If the applicant is unable to complete the work within
the time specified in the approved application, within thirty (30)
