approved by the Department of Inspections and Permits on con-
sultation with the Department of Public Works after reviewing the
cost estimates proposed by the applicant's Professional Engineer and
submitted with the grading permit application. THE PURPOSE
OF THE BOND IS TO GUARANTEE AND INSURE, IN THE
EVENT OF FAILURE TO SATISFACTORILY COMPLETE ALL
WORK AUTHORIZED BY THE PERMIT, THAT THE SITE WILL
BE RESTORED TO A CONDITION MEETING THE MINIMUM
REQUIREMENT OF THIS ARTICLE. IN LIEU OF A PERFORM-
ANCE BOND, A CASH DEPOSIT OR CERTIFIED CHECK, IN
LIKE AMOUNT, MAY BE FILED WITH THE DEPARTMENT
OF INSPECTIONS AND PERMITS SUBJECT TO THE SAME
TERMS AND CONDITIONS AS APPLICABLE TO THE PER-
FORMANCE BOND.
(1) THE CASH DEPOSIT OR BOND SHALL BE IN THE
AMOUNT OF FIVE HUNDRED DOLLARS ($500.00) PLUS FIVE
CENTS (5¢) PER SQUARE FOOT A TOTAL SITE AREA
MINUS THAT AREA TO REMAIN UNDISTURBED AND CUR-
RENTLY HAVING AN EFFECTIVE EROSION RESISTANT
GROUND COVER OR SURFACE, PLUS THE ESTIMATED COST
OF ANY STORM DRAINAGE SYSTEM PROPOSED NOT
COVERED BY PUBLIC WORKS AGREEMENT.
(2) IF ALL WORK OF THE PERMIT IS NOT COMPLETED
WITHIN THE TIME SPECIFIED HEREIN, OR VIOLATES ANY
OTHER TERMS OR CONDITIONS, THE CASH DEPOSIT SHALL
BE FORFEITED, OR IF A BOND HAS BEEN POSTED, PAY-
MENT IN FULL TO ANNE ARUNDEL COUNTY, MARYLAND,
WILL BE ORDERED. THE FUNDS, SO RECEIVED, SHALL BE
USED BY THE COUNTY FOR DEFRAYING THE COST OF CON-
TRACTING, INCLUDING ENGINEERING AND ADMINISTRA-
TION, FOR THE RESTORATION OF THE SITE TO MEET THE
MINIMUM REQUIREMENTS OF THIS ARTICLE WITH PAR-
TICULAR EMPHASIS ON STABILIZATION, SAFETY, DRAIN-
AGE AND EROSION CONTROL. IF THE FOREGOING COSTS
EXCEED THE AMOUNT OF DEPOSIT OR BOND, SUCH EX-
CESS SHALL CONSTITUTE A LIEN ON THE PROPERTY, AND
THE PERMITTEE SHALL CONTINUE TO BE FIRMLY BOUND
UNDER A CONTINUING OBLIGATION FOR PAYMENT OF
ANY AND ALL EXCESS COSTS AND EXPENSES OF ANY
NATURE INCURRED BY THE COUNTY; AND UNUSED POR-
TION OF MONIES FORFEITED SHALL BE RETURNED.
(3) BEFORE ACCEPTANCE, ALL BONDS SHALL BE
APPROVED BY THE BUILDING OFFICIALS AND THE COUN-
TY SOLICITOR. IF A CORPORATION BOND IS OFFERED,
IT SHALL BE EXECUTED BY A SURETY OR GUARANTY
COMPANY QUALIFIED TO TRANSACT BUSINESS IN THE
STATE OF MARYLAND; IF A CASH BOND IS OFFERED,
IT SHALL BE DEPOSITED WITH THE DIRECTOR OF THE
DEPARTMENT OF INSPECTIONS AND PERMITS WHO SHALL
GIVE HIS OFFICIAL RECEIPT THEREFOR, STIPULATING
