2. Return receipts of the mailing referred to in Section 3, and shall
further complete and execute the Certificate of Effect attached hereto.

Resolution No. 71-R-5

TITLE

A Resolution to amend the Charter of the City of College Park,
Maryland, by adding to Article VIII, Section 22 a subsection D, pro-
viding for the placing to automatic and binding referendum certain
actions of the Mayor and Council and establishing limits upon the
time for such referendum to be set.

TEXT

WHEREAS, it is the duly considered opinion of the Mayor and Coun-
cil that there are certain specific issues which should be automatically
subject to a referendum vote by the citizens of the City and that among
these are, specifically, real estate tax rates and the approval of General
Fund bond issues;

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council
of the City of College Park, Maryland, that Subsection D be added to Art-
icle VIII, Section 22 of the Charter of the City of College Park, Maryland,
and that the said subsection read as follows:

Subsection D. Automatic Referendum. When the Mayor and Council
shall find from its determinations that it is necessary to increase the tax
rate or issue general fund bonds, except as otherwise authorized in this
Charter, then such issue or tax increase shall be placed to referendum as

then prescribed and the results of said referendum shall be binding on said
Mayor and Council as provided by law. The Mayor and Council may set
the time and places of said referendum in the usual manner, except that in
no case shall a referendum be delayed beyond the next general election
in the City. In addition, the Mayor and Council may elect, in their discre-
tion, to place other items to automatic and binding referendum by a ma-
jority vote of said Council. Nothing in this subsection shall prohibit or
limit the normal petition procedure provided the citizens of the City.

BE IT FURTHER RESOLVED that the date of the adoption of this
Resolution is March 9, 1971, and that the Amendment to the Charter of the
City of College Park hereby proposed by this enactment shall be and be-
come effective on the 28th day of April, 1971, unless a proper petition for
referendum hereon shall be filed as permitted by law. A complete and exact
copy of the Resolution shall be posted in the City Office until the 18th day
of April, 1971, and a copy of the title of this Resolution shall be published
in a newspaper of general circulation in the City of College Park not less
than four (4) times at weekly intervals before the 18th day of April, 1971.

BE IT FURTHER RESOLVED that, as soon as the Charter Amend-
ment hereby enacted becomes effective, either as herein provided or follow-
ing a referendum, the Mayor of the City of College Park shall send separate-
ly, by registered mail, to the Secretary of the State of Maryland, and to the
