increase in the tax rate ceiling to a maximum of forty-seven (47¢)
cents per one hundred ($100.00) dollars assessed valuation.

TEXT

WHEREAS, it is the opinion of the Mayor and Council, after due and
deliberate study, that the City is in need of additional financial resources;
and,

WHEREAS, the only effective method of obtaining necessary addi-
tional funds left open to the Mayor and Council by State Law is to increase
the property tax; and

WHEREAS, the Mayor and Council pledge to work for other sources
of funds by every method available;

NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council
of the City of College Park, Maryland, that Article XII, Section 43 of the
Charter of the City of College Park entitled Tax Levy, is hereby repealed
and re-enacted as follows:

Section 43. Tax Levy

The tax rate shall not exceed [thirty-eight cents ($0.38)] forty -
seven cents ($0.47)
per each one hundred ($100.00) dollars of assessed
value.

BE IT FURTHER RESOLVED that the date of the adoption of this
Resolution is March 9, 1971, and that the Amendment to the Charter of the
City of College Park hereby proposed by this enactment shall be and be-
come effective on the 28th day of April, 1971, unless a proper petition for
referendum hereon shall be filed as permitted by law. A complete and
exact copy of the Resolution shall be posted in the City Office until the
18th day of April, 1971 and a copy of the title of this Resolution shall be
published in a newspaper of general circulation in the City of College Park
not less than four (4) times at weekly intervals before the 18th day of
April, 1971.

BE IT FURTHER RESOLVED that, as soon as the Charter Amend-
ment hereby enacted becomes effective, either as herein provided or fol-
lowing a referendum, the Mayor of the City of College Park, shall send
separately, by registered mail, to the Secretary of the State of Maryland,
and to the Department of Legislative Reference, the following information
concerning the Charter Amendment:

1.    The complete text of this Resolution:

2.    The date of the referendum election, if any, held with respect
thereto;

3.    The number of votes cast for and against the question contained
in the Charter Amendment whether by the Council of the City of College
Park or in referendum; and

4.    The effective date of the Charter Amendment.

BE IT FURTHER RESOLVED that the Mayor of the City of College
Park be, and is specifically enjoined and instructed to carry out the pro-
visions of Sections 2 and 3, above, as evidence of compliance herewith;
the said Mayor shall cause to be affixed to the Minutes of this meeting:

1. An appropriate certificate of publication of the newspaper in
which the title of this Resolution shall have been published; and
