(3) The cost of installation of such materials does not exceed that
which is usual and customary in that particular locality.

Materials and labor may be furnished by a brandowner for the
custom manufacture of an advertising display not exceeding Fifteen
Dollars ($15.00) which is temporary in nature and has no other
utilitarian value. No manufacturer or non-resident dealer or brand-
owner shall undertake any plan or design which directly or indirectly
results in the purchase of advertising materials or supplies or adver-
tising services by any wholesale or retail licensee; neither shall a
wholesale or retail licensee participate directly or indirectly in any
transaction in which he pays for or shares in the cost for any of the
value of the advertising materials, supplies, services, or mailing ex-
penses utilized to promote a brandowner's products; nothing con-
tained herein is intended to prevent a wholesale licensee from furnish-
ing brandowners as defined herein, with display materials and instal-
lation services at charges, computed at not less than the fair market
value for such services.
Any person violating any of the provisions of
this section shall, upon conviction, be punished by a fine of not more
than [five] one thousand dollars [$5,000.00] ($1,000.00) or by im-
prisonment for not more than two years or by both fine and imprison-
ment in the discretion of the court.

SEC. 2. And be it further enacted, That this Act shall take effect
July 1, 1972.

CHAPTER 726
(House Bill 1153)

AN ACT to repeal and re-enact, with amendments, Section 40(s)
of Article 10 of the Annotated Code of Maryland (1971 Supple-
ment), title "Attorneys at Law and Attorneys in Fact," subtitle
"State's Attorney," authorizing the State's Attorney of St. Mary's
County to appoint a secretary, PROVIDING FOR THE SALARY
OF THE ASSISTANT STATE'S ATTORNEY, and relating gen-
erally thereto.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 40(s) of Article 10 of the Annotated Code of Maryland
(1971 Supplement), title "Attorneys at Law and Attorneys in Fact,"
subtitle "State's Attorney," be and it is hereby repealed and re-
enacted, with amendments and to read as follows:

40.

(s) In St. Mary's County, the State's Attorney's salary is seven
thousand five
hundred dollars $7,500.00) FIFTEEN THOUSAND
DOLLARS ($15,000.00):

The State's Attorney may appoint a competent secretary who shall
be paid a reasonable salary by the County Commissioners of St.
Mary's County upon vouchers submitted by the State's Attorney.
