this subtitle or, in any manner advertise or hold himself out as
engaged in such practice, without first being licensed as a Registered
Professional Forester under this subheading.

409B.

The following terms and definitions apply to this subheading:

(1)    "Registered Professional Forester" means a person who has
registered and qualified pursuant to this subheading to engage in
professional forestry practices as hereinafter defined.

(2)    "Professional forestry" or "practice of professional forestry"
means the business of providing consultation, investigation, evalua-
tion, planning, or responsible supervision of any forestry activities
when this professional service requires the application of forestry
service and technique, but does not include the services of tree experts
as defined by Section 400A of Article 66C of the Code or practices
and services generally provided by arboriculturists, horticulturists,
nurserymen, gardeners, landscape gardeners, landscape contractors
and orchardists.

(3) "Board" means the State Board of Registration for For-
esters provided for in this subheading.

409C.

A State Board of Registration for Foresters is created, whose
duty it is to administer the provisions of this subheading. The Board
shall consist of five professional foresters who shall be appointed by
the Governor of Maryland with the advice and consent of the Senate
by August 1, 1972, from among ten (10) nominees recommended by
the Maryland Chapter, Society of American Foresters, and who shall
possess the qualifications set forth under Section 409D of this sub-
heading. The five (5) members of the initial Board shall be appointed
for terms of one (1), two (2), three (3), four (4) and five (5) years
respectively. On the expiration of the term of any member of the
Board, the Governor shall appoint, in the manner hereinbefore pro-
vided, for a term of five (5) years, a Registered Professional For-
ester from among three (3) nominees recommended by the Mary-
land Chapter, Society of American Foresters, and having the qualifi-
cations set forth in Section 409D of this subheading. Each member
shall hold office until the expiration of the term for which the mem-
ber is appointed or until a successor has been duly appointed and
qualified.
                                                                       

409D.

Each member of the initial Board shall be a citizen of the United
States and a resident of this State for at least three years, possessing
the qualifications to become a Registered Professional Forester un-
der the terms of this subheading, and shall have engaged in the
practice of forestry for at least ten (10) years. Each member here-
after shall be a citizen of the United States and a resident of this
State for at least three years, shall be a Registered Professional
Forester under the terms of this subheading, and shall have engaged
in the practice of professional forestry for at least ten (10) years.
