804. Powers and Duties of the Boards.
The powers and duties of the Boards are as follows:
(1) To administer, coordinate, and enforce the provisions of this
subtitle, ESTABLISH FEES, evaluate the qualifications of appli-
cants, supervise the examination of applicants, and issue subpoenas,
examine witnesses, and administer oaths, and investigate persons
engaging in practices which violate the provisions of this subtitle.
(2) To conduct hearings and keep records and minutes as neces-
sary to an orderly dispatch of business.
(3) To adopt responsible rules and regulations including but not
limited to regulations which establish ethical standards of practice,
and to amend or repeal the same.
(4) To issue annually a list stating the names of persons currently
registered under the provisions of this subtitle.
(5) To employ such personnel as determined by their needs and
budget.
(6) To adopt seals by which they shall authenticate their pro-
ceedings. Copies of the proceedings, records and the acts of the
Boards, and certificates purporting to relate the facts concerning
such proceedings, records, and acts, signed by the Secretaries and
authenticated by the seals shall be prima facie evidence in all courts
of this State.
(7) The conferral or enumeration of specific powers elsewhere
in this Act shall not be construed as a limitation of the general
powers conferred by this Section.
805. ESTABLISHMENT OF FEES; Disposition of Receipts; Pay-
ment of Expenses.
(A) FEES ESTABLISHED BY THE BOARDS SHALL BE
SUFFICIENT TO ALLOW THE BOARDS TO REMAIN SELF-
SUSTAINING, AND ANY SURPLUS OF FUNDS RECEIVED IN
ANY FISCAL YEAR SHALL BE PAID OVER INTO THE GEN-
ERAL FUNDS OF THE STATE.
(a) (B) All expenses incurred by the Boards in the administra-
tion of the provisions of this subtitle shall be paid therefor upon
warrants of the comptroller, when vouchers therefor are exhibited
after approval by the Boards.
(b) (C) Monies received by the Boards in the administration of
this subtitle shall be accounted for to the State Comptroller and
deposited in the State Treasury into separate trust funds for the
Boards.
(c) (D) All salaries and expenses shall be paid as budgeted after
budgets have been approved by the Board of Public Works or within
the limitations of any appropriation for that purpose which may be
included in the General Appropriations Act.
806. Penalties and Remedies.
(a) Any person who violates a provision in this subtitle is guilty
of a misdemeanor, punishable upon conviction by a fine of not more
than $500 or by imprisonment for not more than ninety days}) or both.
