CHAPTER 352
(Senate Bill 726)

AN ACT to repeal and re-enact, with amendments, Sections 266A
to 266-I, inclusive, of Article 41 of the Annotated Code of Mary-
land (1971 Replacement Volume), title "Governor—Executive and
Administrative Departments," subtitle "Department of Economic
and Community Development," subheading "Industrial Buildings
for Counties and Municipalities"; adding new Sections 266A (c)
and (d),266E (c), and 266H-1; dividing Section 266B, as amended,
into 266B (a), (b), (c), (d), (e) and (f); dividing Section 266D,
as amended, into 266D (a), (b), (c) and (d); defining the terms
"industrial building" and "port facility" to include "pollution
control facilities"; defining the terms "acquisition" and "pollution
control facilities"; enlarging the purposes for which any munici-
pality or county may issue revenue bonds under such subheading;
making certain legislative findings; clarifying and restating the
existing authority to provide the terms of the obligations in-
curred; providing authority to sell industrial buildings and port
facilities; providing authority to lend the proceeds of revenue
bonds to acquire industrial buildings or port facilities; and gen-
erally revising the law relating to the issuance of revenue bonds
for industrial buildings and port facilities, including pollution
control facilities.

Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 266A to 266-I, inclusive, of Article 41 of the Anno-
tated Code of Maryland (1971 Replacement Volume), title "Gover-
nor—Executive and Administrative Departments," subtitle "Depart-
ment of Economic and Community Development," subheading "In-
dustrial Buildings for Counties and Municipalities," be and they are
hereby repealed and re-enacted, with amendments, to read as follows:

266A.

(a)  As used in this subheading, the term "industrial building" or
"buildings" means any building or structure, or portion thereof,
suitable for or intended for use as a factory, mill, shop, processing
plant, research and/or development laboratory, warehouse, assembly
plant, fabricating plant, and offices related to any of the foregoing
and/or [the] necessary [operating] or useful machinery and equip-
ment, to be [rented or] leased or sold to an industrial concern (or,
in the case of pollution control facilities, to a public service com-
pany) by the municipality or county by which it is acquired. The
term also means the land [or] site or interests in land necessary
or desirable for the building or structure, together with [access]
roads, or other rights of access, utilities, and other necessary
facilities.

(b)  Port facility means and shall include, without intending
thereby to limit the generality of such term, any one or more of
the following or any combination thereof: lands, piers, docks,
wharves, warehouses, sheds, transit sheds, elevators, compressors,
refrigeration storage plants, buildings, structures and other facili-
ties, appurtenances and equipment necessary or useful in connection
with the operation of a modern port and every kind of terminal
or storage structure or facility now in use or hereafter designed
