bicycle trails along other highways, roads and streets and in parks
and recreational areas.
(c) In any one fiscal year, the amount of highway user revenues
expended by either the State Highway Administration, Baltimore
City, or the several counties and municipalities of the State, shall
not be less than 1% of the highway user revenues Baltimore City,
County or municipality each received during such fiscal year, except
that in IN lieu of actually expending or obligating highway user reve-
nue funds for the purposes authorized PERMITTED by this Section,
the State Highway Administration, the City of Baltimore, and the
several counties and municipalities of the State may credit such funds
to a financial reserve or special fund to be held for not more than 10
years and to be expended only for the purposes required or permit-
ted by this Section.
(c) Footpaths or bicycle trails shall not be required to be estab-
lished under Subsection (a) of this Section, if:
(1) The establishment of the footpaths and bicycle trails would
be contrary to public safety;
(2) The cost of establishing the footpaths and bicycle trails
would be excessively disproportionate to the need or to the probable
use thereof; or
(3) The sparsity of population, the existence of other available
ways or other factors demonstrate an absence of any need for the
footpaths and bicycle trails.
(d) The State Highway Administration, when requested, shall
provide technical assistance and advice to Baltimore City and the
several counties and municipalities of the State in carrying out the
purposes either required or permitted by this Section. The State
Highway Administration shall recommend construction standards
for footpaths and bicycle trails and shall prescribe a uniform sys-
tem of signs for footpaths and bicycle trails which shall apply to
all the footpaths and bicycle trails constructed pursuant to the re-
quirements of Subsection (a) of this Section, whether construction
is undertaken by the State Highway Administration, by Baltimore
City or by the several counties and municipalities of the State.
(e) The use of footpaths and bicycle trails will be restricted to
pedestrians and non-motorized vehicles, unless the State Highway
Administration, Baltimore City, and the several counties and mu-
nicipalities of this State specifically approve other uses. NOTWITH-
STANDING THE PROVISIONS OF THIS SUBSECTION, THE
USE OF FOOTPATHS AND BICYCLE TRAILS SHALL BE DE-
NIED TO SPORTS CYCLES, TRAIL BIKES AND MINI-BIKES.
(f) As used in this Section, "bicycle trails" means a publicly
owned and maintained lane, way or path designated, by appropriate
signs, for use as a bicycle route.
Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1972.
