958                              Laws of Maryland                      [Ch. 434

Every grant, bequest, gift, devise or dedication, or reservation of
any interest, use, easement, right, or estate in real property or the
improvements thereon to or for the Maryland Historical Trust or the
Maryland Environmental Trust WHICH IS RECORDED AMONG
THE LAND RECORDS OF THE POLITICAL SUBDIVISION
AND which is otherwise valid shall be valid and effectual at law
and in equity notwithstanding the fact that the Trusts may neither
be a party to the instrument so granting, giving, dedicating or
reserving the interest, use, right, or estate nor be in actual legal
possession of any estate or interest in real property which is, in
fact, dominant with regard to the interest, use, easement, right or
estate granted, given, dedicated, or reserved.

Whenever any grant, reservation, dedication, or gift of any nature
WHICH IS RECORDED AMONG THE LAND RECORDS OF
THE POLITICAL SUBDIVISION AND which clearly indicates the
maker's intention to subject any interest or estate in real property to
public use for the preservation of historic or environmental qualities
fails to specify a grantee, donee or beneficiary to receive the same or
specifies a grantee, donee, or beneficiary which is not legally capable
of taking the interest or estate, it shall be construed to pass to the
Maryland Historical Trust or the Maryland Environmental Trust
in any proceedings under Sections 195 and 196 of Article 16 of this
Code.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1971.

CHAPTER 434
(Senate Bill 19)

AN ACT to repeal and re-enact, with amendments, Sections 181A,
181E(b), 181E(c), 181E(g), 181G, and 181-1 of Article 41 of the
Annotated Code of Maryland (1965 Replacement Volume and 1970
Supplement), title "Governor—Executive and Administrative
Departments," subtitle "The Executive Department," subheading
"Maryland Historical Trust," providing for the Maryland Histor-
ical Trust to be an instrumentality of the State of Maryland, for
the power to prepare and adopt a statewide historic preservation
plan, for the acquisition of property with prior approval of the
Board of Public Works, for the contracting for services among
State agencies, for the receipt of money and property and the
employment AND STATUS of personnel of the Trust, all to be
effective from the time of the creation of the Trust; and relating
generally to the status and operations of the Maryland Historical
Trust.

Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 181A, 181E(b), 181E(c), 181E(g), 181G and 181-I
of Article 41 of the Annotated Code of Maryland (1965 Replacement
