790                               Laws of Maryland                      [Ch. 383

Section 1. Be it enacted by the General Assembly of Maryland,

That a new Section 9E be and it is hereby added to Article 64A of

the Annotated Code of Maryland (1968 Replacement Volume), title
"Merit System," to follow immediately after Section 9D thereof,
and to read as
follows:

THAT SECTION 334 OF THE CODE OF PUBLIC LOCAL LAWS
OF DORCHESTER COUNTY (1961 EDITION, BEING ARTICLE
10 OF THE CODE OF PUBLIC LOCAL LAWS OF MARYLAND),
TITLE "DORCHESTER COUNTY," SUBTITLE "ROADS," BE
AND IT IS HEREBY REPEALED AND RE-ENACTED, WITH
AMENDMENTS, TO READ AS FOLLOWS:

9E.

On and after July 1, 1971, all employees of the Roads Board of

Dorchester County, Maryland, inciting the Manager thereof shall
be included within the provisions of the
Classified Service of the State
of Maryland and
subject generally to all privileges and responsibili-
ties provided in this Article. All
such employees shall be required to
serve a six months' probationary period expiring December 31, 1971;
and they shall retain their present job
classification or a correspond-
ing job classification within the State Merit System.

334.

(A)   CONTROL. EVERY COUNTY EMPLOYEE ENGAGED
IN THE CONSTRUCTION OR MAINTENANCE OF COUNTY
ROADS OR BRIDGES SHALL BE UNDER THE EXCLUSIVE
JURISDICTION AND CONTROL OF THE COUNTY ROAD EN-
GINEER, EXCEPT AS OTHERWISE PROVIDED IN THIS
SECTION.

(B)  COMPENSATION. SUCH EMPLOYEES SHALL RE-
CEIVE NOT LESS THAN THE HOURLY WAGE RATE PAID
TO STATE EMPLOYEES ENGAGED IN SIMILAR WORK ON
STATE HIGHWAYS IN DORCHESTER COUNTY, AND THE
GRADERS AND TRACTOR OPERATORS SHALL BE PAID THE
SAME COMPENSATION AS THE PERSON OPERATING THE
TRUCKS OF THE STATE ROADS COMMISSION.

(C)  VACATION ALLOWANCE. EACH SUCH EMPLOYEE
WHO HAS WORKED UNDER THE COUNTY ROAD ENGINEER
FOR AT LEAST ONE YEAR, SHALL RECEIVE THE SAME
VACATION, WITH PAY, AT A TIME TO BE DESIGNATED BY
SAID ENGINEER, AND SHALL ALSO BE ENTITLED TO THE
SAME SICK LEAVE, WITH PAY, IN EACH YEAR TO WHICH
EMPLOYEES OF THE STATE ROADS COMMISSION WITH
THE SAME OR SIMILAR CLASSIFICATION ARE ENTITLED.

(D)  INCLEMENT WEATHER. EVERY SUCH EMPLOYEE
WHO PROMPTLY REPORTS FOR WORK AT THE STATE
ROADS BARNS DESIGNATED BY THE COUNTY ROAD EN-
GINEER SHALL RECEIVE AT LEAST ONE-HALF A DAY'S
WAGES, EVEN THOUGH HE DOES NO WORK ON THAT DAY
BECAUSE OF INCLEMENT WEATHER.

(E)  ANY SUCH EMPLOYEE WHO HAS ANY COMPLAINT
OR GRIEVANCE CONCERNING THE TERMS, CONDITIONS,
