784                              Laws of Maryland                      [Ch. 378

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 46B of Article 2B of the Annotated Code of Maryland
(1970 Supplement), title "Alcoholic Beverages," subtitle "General
Provisions on Issue of Licenses," be and it is hereby repealed and
re-enacted, with amendments, to read as follows:

46B.

In Baltimore City, in the second , THIRD and fourth legislative
[district] districts, no new license, or removal of an existing license,
shall be granted to sell alcoholic beverages in any building located
within three hundred (300) feet of the nearest point of the buildings
of a church or school, but the license of any person now holding a
license for any building located within such distance of the building
grounds of a church or school may be renewed or extended for the
same building. [This section shall not apply to any other legislative
district of Baltimore City.]

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1971.

Approved May 6, 1971.

CHAPTER 378
(Senate Bill 482)

AN ACT to repeal and re-enact, with amendments, Section 5 (c)
of Article 38 of the Annotated Code of Maryland (1965 Replace-
ment Volume), title "Fines and Forfeitures," to increase the
amount of money payable each year to the Circuit Court for Cecil
County for use of the court library.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 5 (c) of Article 38 of the Annotated Code of Maryland
(1965 Replacement Volume), title "Fines and Forfeitures," be and
it is hereby repealed and re-enacted, with amendments, to read as
follows:

5.

(c) In Cecil County, if in any year the [said] payment to the
court library of one half the fines imposed and recognizances for-
feited is less than [three thousand dollars ($3,000.00)] four thou-
sand dollars ($4,000.00)
the County Commissioners [thereof] shall
pay to the clerk of the court, for the use of [said] the library, what-
ever amount may be necessary to bring to [three thousand dollars
($3,000.00)] four thousand dollars ($4,000.00) in the aggregate,
the total amount to be paid to [said] the library during that year
under the [workings of this section.] provisions of this section, and
in addition to the amount to be paid as aforesaid, the County Com-
missioners may, in their discretion, pay such sums over and above
the four thousand dollars ($4,000.00) hereinabove provided for, as
they consider reasonable for the proper maintenance of the library.
All sums paid under the provisions of this section shall be expended
