CHAPTER 30
(Senate Bill 91)

AN ACT to add new Section 103A to Article 96A of the Annotated
Code of Maryland (1964 Replacement Volume and 1970 Supple-
ment), title "Water Resources," subtitle "Maryland Potomac
Water Authority," to follow immediately after Section 103 there-
of; and to add new Sections 111 through 126, inclusive, to said
Article, and title of said Code, to follow immediately after Section
110 thereof, and to be under the new subtitle "Potomac River
Basin Compact," and to repeal Sections 407 and 408 of Article 43
of the Code (1965 Replacement Volume and 1970 Supplement),
title "Health," subtitle "Water, Ice and Sewerage," enacting on
the part of the State of Maryland the Potomac River Basin Com-
pact, providing for a Compact among the States of Maryland,
Pennsylvania, Virginia, West Virginia, and the District of Colum-
bia, and with the Federal government for the preservation and
improvement of the Potomac River Basin; providing for the crea-
tion of a Potomac River Basin Commission and for its members,
powers, duties, functions, finances, and operations; providing for
the powers, duties, and functions of the several signatory parties
to the Compact in relation thereto; subject to a certain contin-
gency to repeal the present provisions concerning the Interstate
Commission on the Potomac River Basin; providing for the appli-
cation, effect, and duration of the Compact; amending the provi-
sions concerning the Maryland Potomac Water Authority to pro-
vide for the powers and duties of the Authority concerning the
Compact; and relating generally to the Potomac River Basin and
to its water and other resources.

Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 103A be and it is hereby added to Article 96A of
the Annotated Code of Maryland (1964 Replacement Volume and
1970 Supplement), title "Water Resources," subtitle "Maryland
Potomac Water Authority," to follow immediately after Section 103
thereof, and to read as follows:

103A.

(a)  For the purpose of this section, the Authority shall include,
in addition to its members as prescribed in Sections 89 (j) and 91,
members representing the counties of Carroll, Charles and St. Mary's.
The member representing each such county shall be selected in his
county in the same manner provided for representatives of other
counties in Section 91. Members representing these counties shall
be non-voting with regard to matters pertaining to the Bloomington
Reservoir project until such time as their respective counties would
be assessed for payment under the provisions of Section 96.

(b)   The members of the Authority shall be an advisory committee
to the Maryland member of the Potomac River Basin Commission
and his alternate. The Maryland member of the Potomac River Basin
Commission, either in person or by his alternate on that Commission,
shall confer regularly with the Authority acting in its capacity as
advisory committee. It is the intent and purpose of this section that
the Authority shall be kept regularly informed concerning the pro-
grams, problems and activities of the Potomac River Basin Com-
