and empowered to enforce the provisions of this subtitle, and shall
have the power to define, promulgate and enforce such reasonable
rules and regulations as may be deemed necessary therefor and as
may be not inconsistent therewith.
In order to carry out the provisions of this subtitle, the State
Board of Agriculture, or its agents and employees, are authorized
to enter during the usual hours of business, any warehouse, store,
building, market or any other place, carrier, conveyance, or vehicle
at, in, or from which any eggs are sold, offered or exposed for sale
for the purpose of determining whether the provisions of this sub-
title or the rules and regulations lawfully promulgated in pursuance
thereof shall have been violated; and in addition, if the Board finds
that eggs are being sold, offered or exposed for sale in violation of
any of the provisions of this subtitle, or of any rule or regulation
promulgated pursuant thereto, it may issue a written or printed
"stop sale" order to the person so acting in violation; and it shall
be unlawful for such person, after receipt of such "stop sale" order,
to sell, offer or expose for sale any such eggs with respect to which
such order has been issued. Any person upon whom a "stop sale"
order has been served may appeal to the Board in accordance with
such regulations as the Board may from time to time prescribe.
Any eggs which are found to be adulterated or unfit for human
consumption shall be marked in a permanent manner to permit ready
identification and segregated, and shall, MAY, if no appeal be taken
from such determination of condemnation, be destroyed under the
supervision of an agent of the State Board of Agriculture and in a
manner prescribed by regulations. If any appeal be taken from such
determination, the condemned eggs shall be segregated and stored
pending completion of an appeal inspection. If the determination of
condemnation is sustained, the eggs shall MAY be destroyed in
accordance with this section.

Any person who violates any of the provisions of this subtitle,
or any rule or regulation made thereunder, or who fails or refuses
to make proper reports, as may be required by the enforcing au-
thority, or who reports falsely or with intent to deceive in answer
to any of the requirements of this subtitle, or who interferes with
said State Board of Agriculture, its agents or employees, in the en-
forcement of the provisions of this subtitle, shall be deemed guilty
of a misdemeanor, and, upon conviction thereof, shall, for the first
offense be subject to a fine of not less than [five ($5.00)]
fifty ($50.00) dollars, nor more than [fifty ($50.00)] one hundred
($100.00) dollars, and for any second or subsequent offense shall be
subject to a fine not less than [fifty ($50.00)] one hundred ($100.00)
dollars, nor more than [one hundred ($100.00)] two hundred and
fifty ($250.00) dollars.
Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1971.
